上海自由贸易园区知识产权海关保护问题研究

【摘要】：在现代知识与信息经济高速发展的大环境下,各种影响因素交叉相连其密切程度已经超越一国甚至区域,那么相互之间的合作程度也随之不断深入,其实在很早的时候这种世界范围内的无限制交易市场便已有之。经济一体化的不断发展,世界之间的经济联系加强,特别是我国加入到世贸组织后,加大了对经济领域的相关法律法规的清理,我国的关税大幅度的下降。试想若是我国要尽快融入现代高速经济发展大局之中是否可以借助一些已有或是相对完善的经验、政策如建立自由贸易园区,从而有利于进一步的保护园区内的知识产权,加快上海自由贸易园区的发展。但是,对于自由贸易园区和知识产权海关保护的概念、特征,以及相互之间的关系还有诸多问题。因此,本文对上海自由贸易园区知识产权海关保护问题研究,在理论和实践上都还是有意义。全文将围绕着上海自由贸易园区知识产权海关保护问题研究从三个方面进行书写。继提出本文主要研究对象分析来源与意义之后,而结语则是对自己论文的一个简单的总结和说明。正文共分为四部分,具体内容如下:一、自由贸易园区中知识产权海关保护概述。全球具有各种模式的自由贸易区,很多人对自由贸易园区的到底是怎么一回事还是比较模糊,以及知识产权海关保护等认识也存在问题。本章将对自贸区以及知识产权海关保护概念、特征等进行简要的概述,以及对上海自由贸易园区的定位来对其进行一个初步认识。二、上海自由贸易园区知识产权海关保护的法律及实践困境。本章将对上海自由贸易园区知识产权海关保护的法律及实践困境两个方面进行阐述,从立法和实践两个方面分别进行归纳和总结园区内知识产权海关保护的不足与困境,为后文提出解决措施提供依据。三、域外知识产权海关保护经验对上海自由贸易园区的借鉴。本章主要是介绍在知识产权海关保护方面比较先进的国家和地区,选取了美国、日本以及我国香港地区进行论述。第一节主要对其知识产权海关保护进行一个初步的概述,第二节则对借鉴的可行性分析以及对园区的借鉴进行论述。四、上海自由贸易园区知识产权海关保护的完善建议。这一部分将是本文的重点,本章将先从原则方面进行定位,然后进一步的进行制度上的构建,最后做到实践途径上,这样就可以对我国自由贸易园区的知识产权海关保护提供比较可行的建议。
[Abstract]:In the great environment of the rapid development of modern knowledge and information economy, all kinds of influencing factors are interlinked with each other and their degree of closeness has already exceeded that of a country or even a region, and the degree of cooperation between them has also been deepening. In fact, at a very early stage, this kind of unrestricted trading market in the world was already in place. With the continuous development of economic integration and the strengthening of economic ties between the world, especially after China's accession to the WTO, It has increased the clean-up of relevant laws and regulations in the economic field, and the tariff of our country has dropped by a large margin. If our country wants to integrate into the overall situation of modern and high-speed economic development as soon as possible, we can draw on some existing or relatively perfect experiences. Policies such as the establishment of free trade parks are conducive to the further protection of intellectual property rights in the park and to the acceleration of the development of the Shanghai Free Trade Park. However, with regard to the concept of free trade parks and customs protection of intellectual property rights, There are still many problems in the relationship between them. Therefore, this paper studies the protection of intellectual property rights in Shanghai Free Trade Park. This paper will focus on the study of customs protection of intellectual property rights in Shanghai Free Trade Park from three aspects. The conclusion is a simple summary and explanation of my thesis. The text is divided into four parts, the specific contents are as follows: first, an overview of customs protection of intellectual property in the Free Trade Park. Many people also have problems in understanding what is going on in the Free Trade Park or what is going on, as well as the customs protection of intellectual property. This chapter will give a brief overview of the concept and characteristics of the free trade zone and the customs protection of intellectual property. And the positioning of the Shanghai Free Trade Park to make a preliminary understanding of it. The legal and practical dilemmas of intellectual property Customs Protection in Shanghai Free Trade Park. This chapter will expound the legal and practical difficulties of intellectual property Customs Protection in Shanghai Free Trade Park. From two aspects of legislation and practice, summarized and summarized the shortcomings and difficulties of customs protection of intellectual property rights in the park respectively, and provided the basis for the solutions to be put forward later. This chapter will first position from the principle aspect, then further carries on the system construction, finally achieves the practice way, In this way, we can provide more feasible suggestions for the protection of intellectual property in China's Free Trade Park.
