我国自贸区转运货物的知识产权边境执法制度研究

【摘要】：本文通过分析欧盟和美国的相关制度来研究我国自贸区内关于转运货物的知识产权边境执法制度。引言明确了研究对象、分析了国内外研究现状和研究意义并提出了论文思路和结构。正文共两章,最后是结论。第一章阐述了自贸区转运货物知识产权边境执法的基本理论。首先明确了自贸区的概念和自贸区内海关的法律地位,指出海关在自贸区内享有边境执法权,进口税费除外。其次,界定了转运货物和知识产权边境执法的含义,最后阐明了对自贸区内转运货物进行知识产权边境执法的必要性和正当性。第二章论述了我国自贸区转运货物的知识产权边境执法制度的构建。首先,通过分析比较欧盟和美国的关于转运货物的知识产权边境执法规则,从而明确了我国自贸区转运货物的知识产权边境执法规则,即采纳欧盟的“进入市场可能性论”；其次从适用范围、权利主体范围、执法程序和联合执法四个方面对欧盟于2013年颁布的《海关知识产权保护条例》的海关知识产权执法制度进行了研究；最后,在结合我国现有的关于知识产权边境执法的法律规定的基础上,指出我国应首先明确自贸区海关对于转运货物的知识产权执法权,其次分别从完善现有备案制度、降低申请审查标准、变革实施程序和建立国际合作执法机制等方面来解决我国海关在实际执法中的难题,从而为我国自贸区转运货物的知识产权边境执法制度的构建提供实际可行的有效建议。
[Abstract]:The study of China's trade in goods transport on IPR border enforcement system through the analysis of the relevant system of the European Union and the United States. The introduction clarifies the research object, analyzes the status and significance of the research and put forward the ideas and structure. The text consists of two chapters, the last part is the conclusion. The first chapter expounds the basic theory of the border law enforcement of intellectual property rights of the FTA transshipment. First, a clear legal status of the concept and the FTA FTA customs, customs have pointed out that border enforcement right of free trade in the region, except for import taxes. Secondly, the definition of border enforcement transshipment and the meaning of intellectual property, and finally clarifies the necessity and justification of IPR border enforcement Free Trade Zone transshipment. The second chapter discusses the construction of China's FTA transhipment IPR border enforcement system. First of all, through the Comparison between the European Union and the United States on the transshipment of intellectual property border enforcement rules, in order to make clear of China's FTA transhipment IPR border enforcement rules, namely the adoption of EU "to enter the market possibility theory"; secondly from the scope, the scope of the subject of rights, studied four aspects of law enforcement procedures and joint enforcement of EU promulgated in 2013 "Customs Protection of intellectual property rights regulations on Customs Enforcement of intellectual property rights system; finally, on the basis of our country existing on border enforcement of intellectual property laws and regulations, and points out that China should first clear the FTA customs for transhipment enforcement of intellectual property right, followed by improving the existing filing system, reduce for the standard of review, change implementation procedures and the establishment of international cooperation in law enforcement mechanism so as to solve China's customs problem in the actual enforcement, from It provides practical and effective suggestions for the construction of the border enforcement system of intellectual property rights in the trans shipment of goods in China's free trade area.
