中小企业知识产权担保融资问题研究

【摘要】：中小企业作为我国国民经济发展的重要力量，在增加就业岗位、吸纳新增劳动力、扩大出口能力和稳定国内经济发展等方面，起着极为重要的作用。但是中小企业的融资困难问题却不仅是伴随着中小企业产生与发展，同时也成为制约中小企业持续、稳定发展的一个重要因素。而知识产权担保则可以为企业的融资困难提供一个新的解决途径，但因知识产权本身的特性，目前国内对知识产权用来担保的性质、对知识产权实现方式、价值评估等方面的情况还没有一个统一的认识。本文通过对知识产权担保融资中所涉及的相关概念和制度进行理清，并对其价值评估制度进行初步的探讨，提出建立具有公信力知识产权评价机制的建设框架，以期对知识产权担保的相关制度的完善作出微薄的贡献。 本文通过文献阅读、理论联系实际、比较分析等方法对知识产权担保融资的法律定位（第二章节）进行梳理，同时通过对美、日及台湾地区的以知识产权担保的现状进行比较分析（第三章节）进而对我国的以知识产权担保融资的现状进行初步的分析（第四章节），从而提出完善我国的知识产权担保融资制度的构想（第五章节）。 个人认为文章的创新之处主要在于第二章节、第四章节的对知识产权担保融资的法律定位的现状进行梳理分析，并在第五章节中提出具有公信力的知识产权担保评估制度的设想。
[Abstract]:As an important force in the development of our national economy, small and medium-sized enterprises have increased employment, absorbed new labor force, expanded export capacity and stabilized domestic economic development. But the financing difficulties of small and medium-sized enterprises are not only accompanied by the emergence and development of small and medium-sized enterprises, but also become a constraint to the sustainability of small and medium-sized enterprises. The guarantee of intellectual property rights can provide a new way to solve the financing difficulties of enterprises. However, due to the nature of intellectual property rights themselves, the nature of domestic intellectual property rights is currently used as a guarantee. There is not a unified understanding of the way in which intellectual property rights are realized and the evaluation of value. This paper clarifies the relevant concepts and systems involved in the financing of intellectual property security. This paper also makes a preliminary discussion on the evaluation system of intellectual property rights and puts forward a framework for establishing a credible evaluation mechanism of intellectual property rights in order to make a modest contribution to the perfection of the relevant system of intellectual property guarantee. This paper combs the legal position of IPR secured financing by literature reading, combining theory with practice, comparative analysis and so on. At the same time, it combs the legal position of IPR secured financing (Chapter 2), and at the same time, through the United States, A Comparative Analysis of the current situation of IPR guarantee in Japan and Taiwan (Chapter 3) and a preliminary Analysis of the current situation of IPR secured financing in China (Chapter 4th), thus proposing the improvement of China's knowledge. The conception of security financing system of property right (5th chapter). I think the innovation of the article mainly lies in the second chapter, 4th chapter of the legal positioning of intellectual property rights secured financing to sort out and analyze the current situation. And in 5th chapter puts forward the credible intellectual property right guarantee appraisal system idea.
