商标使用许可法律问题研究

【摘要】：商标使用许可，是指商标注册人在保留商标专有权的情况下，允许他人在一定期限内使用其注册商标。商标使用许可是注册商标专用权人发挥其商标效用的一种重要形式。近几年发生的一些典型知识产权案例，如“娃哈哈”、“王老吉”商标使用许可案，反映出我国《商标法》等法律法规在商标使用许可备案制度、协调商标使用许可权利冲突以及平衡商标使用许可双方的利益分配等方面，还存在着法律制度设计的缺陷，需要不断加以完善。同时，也突显出企业需要反思自身的商标管理策略，不断提升企业的商标管理和商标使用许可管理，才能使商标为企业创造出更大价值。本文根据典型案例所涉及的法律问题，在现有理论研究基础上，根据自己的思考和研究，运用了文献研究法、个案研究法、比较分析法、实证分析法等研究方法，提出了完善我国商标使用许可备案制度、协调商标使用许可权利冲突、平衡商标使用许可利益分配的建议。以进一步引起理论界和实务界对商标使用许可制度的关注和研究，从而不断完善我国商标使用许可相关法律制度。本文共分为六章：第一章为绪论。第二章为商标使用许可典型案例及其法律问题。第三章为商标使用许可备案法律问题。第四章为商标使用许可中的权利冲突问题。第五章为商标使用许可中的利益分配问题。本文第二章通过典型案例引出拟研究的三个商标使用许可法律问题，即商标使用许可的备案问题、权利冲突问题和利益分配问题，第三章、四章、五章为分论，通过案例的分析和理论的论述，，分别对商标使用许可的备案、权利冲突和利益分配问题，提出了具体的完善意见和建议。本文最后为结语，对本文的重点论述和观点进行了回顾和总结，对后续需要继续研究的问题作出了说明。
[Abstract]:"permission to use a trademark" means that the trademark registrant retains the exclusive right of the trademark, Allowing others to use their registered trademark within a certain period of time. The trademark use license is an important form for the registered trademark exclusive owner to exert its trademark utility. In recent years, some typical cases of intellectual property rights have occurred. For example, the "Wahaha" and "Wang Laoji" trademark licensing cases reflect our country's trademark law and other laws and regulations in the trademark use license record system. There are still some defects in the design of legal system in coordinating the conflict of trademark use and licensing rights and balancing the distribution of interests between the two sides of the trademark use license. At the same time, it needs to be improved constantly. It also highlights the need for enterprises to reflect on their own trademark management strategies and constantly improve the trademark management and trademark licensing management in order to create greater value for enterprises. According to the legal problems involved in typical cases, on the basis of existing theoretical research, according to my own thinking and research, this paper applies the methods of literature research, case study, comparative analysis, empirical analysis, etc. Some suggestions are put forward to perfect the registration system of trademark use license in our country, to coordinate the conflict of trademark use license rights, to balance the distribution of trademark license benefits, so as to arouse the attention and study of the trademark use license system in the theoretical and practical circles. In order to constantly improve our trademark licensing related legal system. This article is divided into six chapters: the first chapter is the introduction, the second chapter is the typical cases of trademark use license and its legal problems, the third chapter is the legal problem of trademark use license filing. Chapter 4th is the conflict of rights in trademark use license. Chapter 5th is the problem of distribution of benefits in trademark licensing. The second chapter of this paper leads to the three legal problems of trademark licensing through typical cases. The third, fourth and fifth chapters are divided into two parts. Through the case analysis and theoretical discussion, the author puts forward the record of trademark use license, respectively, in the third chapter, the fourth chapter, and the fifth chapter, respectively, through the case analysis and the theory discussion, the trademark use license record question, the rights conflict question and the benefit distribution question, In the end, the author reviews and summarizes the emphases and viewpoints of this paper, and explains the problems that need to be further studied in the future.
