商业方法专利的客体审查标准研究

【摘要】：商业方法的可专利性一直是知识产权界的一个争议热点。虽然美、日、欧都陆续接受了商业方法专利，但他们各自对商业方法专利客体的审查标准和审查步骤也不尽相同。美国在Bilski案后对客体审查标准进行了大幅的调整。而我国对商业方法的可专利性并未在立法层面予以规制，对商业方法专利的授权也始终保持谨慎的态度，以严格的客体审查控制着授权率。审查实践中，以专利法第2条第2款“非技术方案”为由否定可专利性的矛盾比较突出。本文系统地梳理了美欧商业方法专利客体审查标准的演替和我国商业方法专利的客体审查标准，同时结合我国审查实践，探讨适应我国现实国情的客体审查方法。本文由引言、主体部分和结语三大部分组成。引言中介绍了本文选题的背景、研究内容及研究方法，综叙了国内外的研究现状。本文的主体部分为第一章至第三章。第一章为商业方法专利的相关概念，主要介绍并厘清了与商业方法专利相关的几个容易混淆的概念，具体包括：商业方法、商业方法专利、计算机软件专利、可专利客体和技术性，并将本文的研究重点聚焦于“以利用计算机及网络技术实施商业方法为主的发明的客体审查标准”上。第二章为美欧商业方法专利客体审查比较研究。本文选取美国和欧盟为代表，重点研究了这2个国家在商业方法专利客体审查上的历史演进，详细介绍了这2个国家现行的客体审查标准和具体的审查步骤。第三章为我国商业方法专利客体审查标准与完善建议。从我国现行的审查标准出发，结合具体的审查意见，，分析了我国现行审查标准中的问题和我国审查实践中的制约，并借鉴国外审查经验，对我国商业方法专利的客体审查提出了完善建议。结语中再次总结了“在现阶段，我国可以从‘严格的客体审查’逐步向‘宽松的客体审查、严格的实质性条件审查’过渡，并根据实际情况把握商业方法专利的创造性标准”的观点。
[Abstract]:The patentability of business methods has always been a controversial issue in the intellectual property field. Although the United States, Japan and Europe have accepted business process patents one after another, However, their standards and steps of examination of the object of business method patent are different. After the Bilski case, the United States has made a substantial adjustment to the object review standard, but the patentability of business method in China has not been regulated in the legislative level. In practice, the contradiction of denying patentability on the grounds of Article 2 (2) of Patent Law is obvious. This paper systematically combs the succession of the object examination standard of business method patent in America and Europe and the object examination standard of business method patent in our country. At the same time, combined with the examination practice of our country, this paper discusses the object examination method which adapts to the actual situation of our country. This paper is composed of three parts: introduction, main part and conclusion. The introduction introduces the background, research content and research methods of this topic. The main part of this paper is chapters 1 to 3. The first chapter is the related concepts of business method patent, which mainly introduces and clarifies several confusing concepts related to business method patent. Including: business method, business method patent, computer software patent, patentable object and technology, The research focus of this paper is on "Standards of object examination of inventions based on the use of computer and network technology". Chapter two is a comparative study of patent object review of business methods in the United States and Europe. The United States and the European Union are the representatives, Focusing on the historical evolution of the business method patent object review in these two countries, This paper introduces in detail the existing object examination standards and specific examination steps in these two countries. Chapter three is the standards and suggestions for the object examination of business method patents in China. This paper analyzes the problems in the current auditing standards of our country and the constraints in our country's audit practice, and draws lessons from the experience of foreign countries, and puts forward some suggestions to perfect the object examination of the patent of business methods in our country. Our country can gradually transition from 'strict object examination' to 'loose object examination, strict substantive condition examination', and grasp the creative standard of business method patent according to the actual situation.
