论中国企业对专利强制实施许可制度的运用

【摘要】：国家发展知识产权战略适应信息时代的国际化要求，将“创新”作为一种国家战略，“自主创新”当然对我国创新型国家的建设、科技水平的提高、企业的迅猛发展等方面具有重要作用。但强调“自主创新”并不排除对已经存在的他人专利权的强制许可使用。强制许可制度是知识产权专利领域中，实现知识产权利益平衡原则的重要手段和体现。强制许可的价值表现在能够激励个体进行技术创新活动，并且保障技术创新成果的推广与应用，符合专利制度建立的目的。但从中国专利制度实行以来，截止目前专利强制许可事例仍处于零状态。这种专利强制许可在中国零事例的事实，难免引起人们的困惑：是中国现实的经济领域中不存在应用专利强制许可制度的情形；还是中国的经济实体没有掌握专利强制许可制度，不能有意识地运用专利强制许可制度；亦或是目前中国的专利强制许可制度本身存在问题，难以在现实经济生活中运用。而企业是实施专利的主导力量，也应是申请专利强制许可的主力军，是专利强制许可制度的主体，本文通过对企业申请强制许可的准备阶段、申请阶段、审批阶段、救济阶段的研究，，提出对中国专利强制实施许可制度的立法建议，以期帮助中国企业更好的运用专利强制许可制度。
[Abstract]:The national strategy for developing intellectual property rights meets the requirements of the internationalization of the information age, and regards "innovation" as a national strategy. "Independent innovation" of course will improve the level of science and technology in the construction of an innovative country in China. The rapid development of enterprises plays an important role, but the emphasis on "independent innovation" does not exclude the compulsory licensing of existing patent rights of others. Compulsory licensing system is an important means and embodiment of the principle of balancing the interests of intellectual property rights in the field of intellectual property rights patent. The value of compulsory licensing is that it can stimulate individuals to carry out technological innovation activities. And ensure the promotion and application of technological innovation results, in line with the purpose of the establishment of the patent system. However, since the implementation of the patent system in China, the cases of compulsory licensing of patents have remained at zero. The fact that such compulsory licensing of patents is zero in China, Inevitably, people are puzzled: there is no patent compulsory licensing system in China's real economic field, or the Chinese economic entities do not master the patent compulsory licensing system, can not consciously use the patent compulsory licensing system; Or the current patent compulsory licensing system in China itself has problems, difficult to use in real economic life. Enterprises are the leading force in the implementation of patents, should also be the main force in applying for compulsory patent licensing, and the main body of the patent compulsory licensing system. This article, through the preparation stage, application stage, examination and approval stage, for enterprises to apply for compulsory licensing, In order to help Chinese enterprises to make better use of compulsory patent licensing system, the author puts forward some legislative suggestions on the enforcement of patent licensing system in China.
