商号权法律保护的研究

【摘要】：伴随我国渐渐完善的市场经济体系，人们的法律意识越来越强了，，更懂得用权利和义务来保护自己，越来越多的人选择用法律来保护自己，当自己的权益受损时。在这样的大环境下，研究商号权的保护无疑显得非常必要和及时。尽管商号权的保护在国际上已经有相当长的历史，在我国也得到越来越多的认同，但如何通过法律形成有效的保护却仍然是一个重要课题。商号权是一项重要的知识产权，实践表明，对于商号权的保护应该纳入知识产权保护的范畴我国对于知识产权的保护正在逐步加强，在这样一个大环境下，研究商号权理论，建立和完善我国商号权的保护制度，不仅具有理论意义，而且具有紧迫的现实意义。全文一共分为四部分。第一部分为商号权的概述，包括：商号与商号权、商号权的性质探讨、商号权法律保护的意义。第二部分为我国商号权存在的问题分析，具体包括：现行法律没有对商号进行明确的定义和定性、我国缺少一部专门保护商号权的单行法、我国商号权管理体制上存在漏洞、我国商号权的排他效力和救济效力不足、我国商号权与其他权利的保护缺乏协调。第三部分为域外对商号权保护制度的经验借鉴，具体包括：域外商号权保护的立法模式的借鉴，域外商号权保护的内容的借鉴，保护的救济途径的借鉴。第四部分为我国商号权保护的完善，包括：明确定义和定性商号，建立一部专门保护商号权的单行法，完善我国商号权管理体制，加强我国商号权的排他效力和救济效力，协调好我国商号权与其他权利的保护。
[Abstract]:With the gradual improvement of the market economy system in our country, people's legal consciousness is getting stronger and stronger, and they know how to protect themselves with rights and obligations. More and more people choose to protect themselves by law. When one's own rights and interests are damaged. Under such circumstances, it is undoubtedly necessary and timely to study the protection of the right to trade name. Although the protection of the right of trade name has a long history in the world, it has also gained more and more recognition in our country. However, how to form effective protection by law is still an important issue. Trade name right is an important intellectual property right, which has been proved by practice. The protection of trade name right should be brought into the scope of intellectual property protection. In such a big environment, we should study the theory of trade name right and establish and perfect the protection system of trade name right in our country. It is not only of theoretical significance, but also of urgent practical significance. The full text is divided into four parts. The first part is an overview of trade name rights, including: business name and trade name rights, the nature of business name rights, The second part is the analysis of the problems existing in the trade name right in our country, including: the current law does not have a clear definition and qualitative definition of the trade name, and there is a lack of a special law to protect the trade name right in our country. There are loopholes in the management system of trade name right in our country, the exclusive effect and relief effect of business name right in our country are insufficient, and the protection of trade name right and other rights in our country is not coordinated.
