解开秘方之秘

【摘要】：中药秘方属于中国传统医学知识的有机部分,存在形式各异,来源多元,疗效以国家级保密方剂、中医药老字号秘方以及中医院的院内制剂最为显著,实属一笔可以更广泛地加以挖掘的医疗资源。但目前只有国家级保密方剂可以不公开技术秘密就能生产上市,其他秘方或被限定在一个较小的范围内使用,或因不能注册生产而被束之高阁,此乃中药秘方之悲哀。秘方困境之根本在于保护传统医学知识的逻辑与现代知识产权制度的专利保护措施实为一种不可兼容的关系,需要另辟途径,找到一条解开秘方之秘的道路。为此,建议将联合国《生物多样性公约》有关生物资源开发以及相关传统知识利用的"惠益分享"原则,借用到解开秘方之秘的努力之中,为提高公民健康水平做出贡献。
[Abstract]:The secret prescription of traditional Chinese medicine is an organic part of Chinese traditional medical knowledge. It has different forms and diverse sources. The curative effects are most remarkable in the state-level secret prescription, the secret prescription of the old name of traditional Chinese medicine and the hospital preparations in the Chinese medicine hospital. It is a medical resource that can be excavated more widely. But at present, only national secret prescriptions can be produced and marketed without disclosure of technical secrets, and other secret prescriptions may be used in a smaller scope. This is the sorrow of the secret prescription of traditional Chinese medicine. The root of the dilemma lies in the incompatibility between the logic of protecting traditional medical knowledge and the patent protection measures of the modern intellectual property system. Another way is needed to find a way out of the mystery. To this end, it is recommended that the "benefit-sharing" principles of the United Nations Convention on Biological Diversity relating to the development of biological resources and the use of relevant traditional knowledge be brought to bear, Borrow the secret of the secret of the efforts to improve the health of citizens to contribute.
