文化创意产业版权集体管理法律问题研究

【摘要】:自英国提出文化创意产业这一概念以来,人们对它的研究和探索热情就没有减退过,它也没有辜负人们对它的期望,带来了巨大的经济利益,成为许多国家的战略性产业。在当今法制社会的背景下,文化创意产业的发展与繁荣都离不开法律制度的保护。文化创意产业主要得意于知识产权的保护,特别是版权保护,版权保护从文化创意作品构思、产生到传播过程进行全方位的保护,促进创新成果市场化和产业化。而版权的集体管理制度在文化创意产业保护中也发挥着巨大的作用,它使版权贸易更加便捷,提高利用效率。借鉴外国的版权集体管理制度,分析我国文化创意产业的现状和存在问题,探寻其完善方法,对于我国创意产业版权的保护问题具有极大现实和理论意义。 立足于我国文化创意产业的现实背景,结合我国版权方面的法律制度,对过去经验教训进行总结提出解决方法,是本文研究的总体思路。 本文总共分为五个部分。第一部分是文化创意产业介绍,从国内外不同的定义揭示对文化创意产业不同的理解;同时介绍其创新性、文化性、高回报和高风险性,,以及高融合性等国内外普遍认同的特点,另外对文化创意产业国内外发展情况进行介绍,说明其在当今经济体系的重要地位。第二部分主要论述文化创意产业涉及版权集体管理的内容、版权集体管理组织和版权集体管理的重要意义。第三部分是对美国、欧盟版权集体管理制度的介绍,说明我国可能从中学取经验。第四部分是我国文化创意产业版权集体管理立法和实施现状、集体管理组织目前面临的问题。第五部分是本文的观点部分,意在说明文化创意产业版权集体管理制度的必要性,健全其法律规范,以及文化创意产业视角下版权集体管理组织应做的相应改变改变。 版权集体管理制度对文化创意产业的发展作用巨大,需要在实践者逐步完善,同时它也面临着许多新的问题,希望在这些问题上引起更多法律人的关注,提出更好的完善方法。
[Abstract]:Since Britain put forward the concept of cultural and creative industry, people's enthusiasm for its research and exploration has not diminished, and it has not failed to live up to the expectations of people, and has brought enormous economic benefits. Under the background of today's legal society, the development and prosperity of cultural and creative industries can not be separated from the protection of legal system. The cultural and creative industries are mainly proud of the protection of intellectual property rights, especially the protection of copyright. Copyright protection from the conception of cultural and creative works to the process of dissemination of all-round protection to promote the marketization and industrialization of innovative achievements, and the collective management system of copyright also plays a great role in the protection of cultural and creative industries. It makes the copyright trade more convenient and improves the utilization efficiency. Using the foreign copyright collective management system for reference, it analyzes the present situation and existing problems of the cultural and creative industries in our country, and probes into its perfect methods. It is of great practical and theoretical significance to protect the copyright of creative industry in China. Based on the realistic background of China's cultural and creative industries and the legal system of copyright in our country, the author sums up the past experiences and lessons and puts forward some solutions, which is the general idea of this paper. This paper is divided into five parts altogether. The first part is the introduction of cultural creative industry, which reveals different understanding of cultural creative industry from different definitions at home and abroad, and introduces its innovation, cultural nature, high return and high risk. As well as the characteristics that are generally recognized at home and abroad, such as high integration, in addition to introducing the development of cultural and creative industries at home and abroad, The second part mainly discusses the content of cultural creative industry involved in copyright collective management, the significance of copyright collective management organization and copyright collective management. The introduction of EU copyright collective management system shows that China may learn from it. The fourth part is the legislation and implementation of copyright collective management in Chinese cultural and creative industries. The fifth part is the viewpoint of this paper, which is intended to explain the necessity of the collective management system of cultural and creative industry copyright, and improve its legal norms. And cultural and creative industries under the perspective of collective copyright management organizations should make corresponding changes. The system of collective copyright management plays a great role in the development of cultural and creative industries, and needs to be gradually perfected by practitioners. At the same time, it also faces many new problems, hoping to arouse more legal attention on these issues. Put forward better perfect method.
