我国出口遭受知识产权贸易壁垒及应对策略研究

【摘要】：伴随我国产业结构和出口产品结构的升级，出口产品科技含量提高，，我国出口产品遭受了越来越多的国外知识产权贸易壁垒。我国出口贸易中有关知识产权的纠纷已成为热点问题。本文在前人研究的基础上，主要阐述了国外知识产权贸易壁垒的设置现状，和我国遭受的状况、分析了设置的经济学理论、设置动因和我国中招的原因；并从实证研究的角度分析了知识产权贸易壁垒带来的影响；最后从我国实际出发，提出了我国应对国外知识产权贸易壁垒的策略建议。本文主要框架结构如下：第一章，概述本文的研究背景与意义，介绍国内外研究现状。第二章，阐述知识产权贸易壁垒的涵义、特征和主要表现形式。第三章，介绍国际上知识产权贸易壁垒的主要制度，尤其是美国、欧盟等拥有知识产权优势的国家关于知识产权贸易壁垒的法律状况，并分析这些国家设置和使用知识产权贸易壁垒的经济学理论及其动因。第四章，用具体数据和图表阐述我国企业遭受知识产权贸易壁垒的现状，用实证分析了遭受的影响，并分析产生的内部原因和外部原因。第五章，提出我国应对知识产权贸易壁垒的策略，结合我国实际遭受的贸易壁垒情况，从宏微观角度提出应对的策略建议。
[Abstract]:With the upgrading of China's industrial structure and export product structure, the scientific and technological content of export products has increased. China's export products suffer more and more foreign intellectual property trade barriers, and disputes about intellectual property rights in China's export trade have become a hot issue. On the basis of previous studies, this paper mainly expounds the present situation of foreign intellectual property trade barriers, and the situation of our country, analyzes the economic theory of setting up, the motivation of setting up and the reasons of our country's success. From the perspective of empirical research, this paper analyzes the impact of trade barriers to intellectual property rights, and finally, from the reality of our country, puts forward some suggestions for our country to deal with foreign trade barriers to intellectual property rights. The main structure of this paper is as follows:. The first chapter summarizes the research background and significance of this paper, introduces the current research situation at home and abroad. The second chapter expounds the meaning, characteristics and main forms of intellectual property trade barriers. The third chapter introduces the international intellectual property trade barriers, especially the United States, the European Union and other countries with intellectual property advantages on intellectual property trade barriers to the legal situation, It also analyzes the economic theory and its motivation of setting up and using trade barriers to intellectual property rights in these countries. In the fourth chapter, the author uses concrete data and charts to explain the current situation of Chinese enterprises suffering from intellectual property trade barriers, and analyzes the internal and external causes with empirical analysis. In the fifth chapter, the author puts forward the strategies to deal with the trade barriers to intellectual property rights in our country, and puts forward some suggestions from the macro and micro angle according to the actual situation of trade barriers suffered by our country.
