针对视障人士的合理使用制度研究

【摘要】：全世界约有2.85亿视障人士，且绝大部分都集中在发展中国家，而每年出版所有图书中只有不到5%提供了无障碍格式版本供视障人士使用。一些国际组织早就开始了针对视障人士的版权限制的研究并通过了相关条约，许多发达国家的国内法上也有更为细致的规定。我国现行《著作权法》对视障人士的关注程度远远不够，视障人士能够利用合理使用制度使用的作品来源无法从法律上得到保障，而学界对该领域的研究也屈指可数。本文运用文献研究的方法，首先针对视障人士的合理使用制度的价值及其功能进行分析，探讨了合理使用的性质、针对视障人士的合理使用制度建立的特殊性和必要性，为该制度的存在提供了理论基础。然后对国际上针对视障人士的合理使用制度进行比较研究，主要阐述了重要的知识产权国际条约和几个主要发达国家的著作权合理使用制度中的有关视障人士的条款，通过评析和比较，为我国的针对视障人士的合理使用制度积累先进的经验。最后指出我国著作权法上该特殊合理使用制度的不足之处，借鉴国际组织和发达国家在这一领域的研究成果，，为我国针对视障人士的合理使用制度的完善提出建议，从主体、客体和行为三大类进行分析，具体包括该项合理使用制度的受益人、从事合理使用行为的主体、可使用的作品范围、作品可转换的形式、使用主体的行为方式、使用行为的商业性、无障碍格式版作品的进出口和技术措施等方面的问题。
[Abstract]:There are about 285 million visually impaired people in the world, most of them in developing countries, and less than 5% of the books published each year provide accessible formats for the visually impaired.A number of international organizations have long begun to study copyright restrictions on visually impaired persons and have adopted relevant treaties, and many developed countries have more detailed provisions in their domestic laws.The present copyright Law of our country is far from paying enough attention to the visually impaired persons. The sources of works used by the visually impaired persons can not be guaranteed by law, and the academic research in this field is limited.In this paper, the method of literature research is used to analyze the value and function of the reasonable use system of the visually impaired persons, and to discuss the nature of the reasonable use and the particularity and necessity of the establishment of the reasonable use system for the visually impaired persons.It provides a theoretical basis for the existence of the system.Then it makes a comparative study on the international fair use system for the visually impaired, mainly expounds the important international treaties on intellectual property rights and the provisions concerning the visually impaired persons in the fair use system of copyright in several major developed countries.Through the analysis and comparison, it accumulates advanced experience for the reasonable use system of visually impaired persons in our country.Finally, it points out the shortcomings of the special reasonable use system in copyright law of our country, draws lessons from the research results of international organizations and developed countries in this field, and puts forward some suggestions for the perfection of the reasonable use system of the visually impaired persons in our country.The object and the behavior are analyzed, including the beneficiary of the reasonable use system, the subject engaged in the reasonable use behavior, the scope of the work that can be used, the convertible form of the work, the behavior mode of the use subject,Use of commercial, accessible format version of the import and export of works and technical measures and other issues.
