服装产业的知识产权比较研究

【摘要】：服装产业有着巨大的发展潜力,其在全球每年创造大约7500亿美元的利润,不仅促进了国际产业的繁荣,而且对经济的发展、就业的拉动也起着非常重要的作用。服装不仅仅是人们遮体避寒的生活必需品,也是一种艺术、价值理念的表达形式。服装制作过程中所产生的服装效果图、服装结构图以及服装作为服装设计师的智力成果应当得到知识产权相关法律的保护。然而世界各国对于服装产业的保护现状各不相同。作为时装之都的法国早已于19世纪就给予服装设计外观设计保护,并且于20世纪将服装设计纳入到知识产权法典中予以严格保护。有着繁荣的服装产业的英国也给予服装一定的保护。而且意识到服装产业巨大价值的美国也正在努力试图给予服装产业以保护。服装产业繁荣的国家对服装产业的重视度不断地提高,都通过采取相应的措施来促进本国服装产业的发展以促使服装产业的积极作用得到充分地发挥。但是作为时装大国的我国,其知识产权法律体系中并未有对服装产业予以保护的相关条款,这种现状也抑制了我国服装产业促进经济增长、增加就业、稳定社会等积极作用的发挥。本文共包括四部分。本文第一部分从服装的概念、服装的制作步骤、服装的发展现状入手,引出服装产业亟需知识产权相关法律保护的必要性。第二部分介绍了美国知识产权法、法国知识产权法典、英国知识产权法等对服装产业的保护模式。第三部分从我国知识产权相关法律对服装产业的保护现状入手,提出我国对服装产业应当建立健全以著作权法为重点的多重保护模式以促进我国服装产业在世界服装产业中地位的提升。第四部分在对前三章内容简要总结的基础上,提出我国应当借鉴其他知识产权对服装产业的保护模式并健全符合我国国情的知识产权相关法律的同时,服装企业、服装设计师也应当提高自身的知识产权保护意识,并发挥服装行业协会的作用,以促使我国服装产业快速而稳健地发展。
[Abstract]:Garment industry has great development potential, which generates about 750 billion dollars in profit every year in the world. It not only promotes the prosperity of international industry, but also plays a very important role in the development of economy and the promotion of employment. Clothing is not only a necessity for people to hide from the cold, but also a form of expression of art and value concept. The clothing effect diagram, the clothing structure diagram and the clothing designer's intellectual achievement should be protected by the law of intellectual property. However, the current situation of clothing industry protection varies from country to country. France, as the fashion capital, had already given the design protection in the 19th century, and in the 20th century, the clothing design was included in the intellectual property code to be strictly protected. Britain, which has a thriving clothing industry, also gives clothing some protection. And the United States, aware of the value of the garment industry, is also trying to protect the industry. The countries with prosperous garment industry pay more and more attention to the garment industry. They all take the corresponding measures to promote the development of the clothing industry in order to promote the positive role of the clothing industry to be brought into full play. However, as a fashion country, China's intellectual property law system does not have the relevant provisions to protect the clothing industry. This situation has also restrained the clothing industry in our country from promoting economic growth and increasing employment. Stable society and other positive role of play. This paper consists of four parts. The first part of this paper starts with the concept of clothing, the steps of garment production, and the current situation of clothing development, leading to the necessity of the clothing industry in urgent need of intellectual property rights related legal protection. The second part introduces the American intellectual property law, the French intellectual property code and the British intellectual property law. The third part starts with the current situation of the protection of clothing industry under the relevant laws of intellectual property of our country. This paper puts forward that our country should establish and perfect the multi-protection mode with the emphasis of copyright law to promote the status of China's garment industry in the world. In the fourth part, on the basis of summarizing the contents of the first three chapters, the author points out that our country should draw lessons from other intellectual property rights to protect the garment industry and perfect the relevant laws of intellectual property rights which are in line with the national conditions of our country, at the same time, the garment enterprises, Fashion designers should also improve their awareness of intellectual property protection and give play to the role of clothing industry associations in order to promote the rapid and steady development of China's garment industry.
