创新驱动战略下我国专利保险的发展模式选择

【摘要】：改革开放以来,我国的经济得到了迅速发展,在金融危机之后,世界各国都在加快经济社会的转型,其中各国竞争的关键在于科技创新。我国在十八大上把创新驱动战略作为我国未来一段时期发展的核心战略。实施创新驱动战略需要不断提高我国的自主创新能力,而在科技创新中,专利权的运用发挥着至关重要的作用。近几年我国的专利事业有了长足的发展,但值得注意的是专利保护情况仍然堪忧。专利保险是以经济手段对专利进行保护的重要工具之一。欧美发达国家在上个世纪八十年代就出现了专利保险,在运行过程中积累了很多经验,我国在2009年正式开始试点专利保险。本文在引述国外专利保险分析的基础上,结合我国专利保险试运行的现状,对我国的专利保险的创新发展模式进行研究。本文研究内容大致结构分为以下几个主要部分：第一部分的绪论阐述了本文的研究背景、文献综述、内容以及可能的创新之处与不足。首先本文的研究背景是随着我国经济社会的发展所面临的对科技创新的需求增加,创新驱动战略作为我国的核心战略,而专利权的运用在实施创新驱动战略的过程中又有着至关重要的作用,如何对专利权进行有效的保护,如何发展适合我国的专利保险模式这一问题就亟待解决,所以本文的研究意义主要在于对此问题进行探讨并提出浅薄的建议。文献综述主要介绍了国内外有关于专利保险发展模式以及相关问题的研究情况。最后研究内容和可能的创新之处在于结合我国目前的专利试点情况,对国外专利保险模式分析的基础上对我国专利保险的发展进行探讨,即研究重点在于结合我国的试点情况进行分析。第二部分全面介绍了专利保险的基础内容。主要为专利保险的含义,及专利保险的一种主要分类方法即分为专利执行保险和专利侵权责任保险,并介绍了两种专利保险的区别,同时也分析了专利保险相较于一般有形财产保险的特殊性分析,为文章提供了理论基础。第三部分,创新驱动战略及我国开展专利保险的必要性研究。本章主要介绍了我国在十八大上所提出的创新驱动战略的基本内涵,基于对创新驱动战略的介绍引出我国科技创新的重要性,从而引出了我国目前的专利发展情况以及专利的侵权情况,在此基础上,对我国实施创新驱动战略与我国的知识产权保护的关系进行了分析,最后,在以美国337调查为例的基础上,对我国在对外贸易中的专利诉讼及损失情况进行了介绍,突出了我国实施专利保险的重要性。第四部分,介绍了美国和欧盟的专利保险的发展模式。分别对美国和欧盟的专利保险的发展背景,以及发展的现行模式进行了分析。对于美国专利保险的分析主要对IPISC公司的知识产权保险体系进行了介绍,在对欧盟专利保险介绍方面,主要对CJA咨询公司的研究报告进行了分析。最后对美国和欧盟的专利保险进行总结和对比。第五部分着重介绍和分析了我国专利保险的现状,通过查阅新闻以及主要职能部门网站的形式,对我国目前专利保险的现状进行了分析。我国目前在多地开展了专利保险的试点工作,推广险种为专利执行保险。现阶段采取的是商业保险为主体、政府扶持的模式。试点工作取得了一定的成效,但仍然存在着可供选择险种单一、保障力度不足、参保率低等问题。第六部分主要对我国专利保险应选择何种模式进行了分析,主要对现有的专利保险的强制模式、半强制模式以及欧盟的中小企业专利互助保险的模式进行了理论上的对比分析,再结合我国目前专利诉讼情况以及专利保险条款进行分析。本文认为我国应推行强制型或者中小企业互助的专利保险模式,这样可鼓励中小企业参与专利保险,确保大数法则的运用。第七部分,我国专利保险的可持续发展的政策建议。本文认为政府应为专利保险提供一段较长时期的补贴以及良好的发展环境和政策上的支持；而保险人方面应积极开发多种专利保险产品,满足专利人不同类别的专利风险,同时保险人也应确定合理的保障水平,满足专利人不同水平的专利风险保障需求；再者在外部环境方面,需要完善我国专利评估体系以及专利法律服务机构,加强企业的专利风险管理理念,建立合适的专利风险管理策略。第八部分,在全面总结整篇论文的基础上,概况本文的中心论点,作为本文的结论部分。本文的可能创新之处在于：第一,对欧盟和美国的专利保险进行了时间和空间上的对比比较,分别分析了两个地区的专利保险的发展历程,体现了欧美不同经济环境中专利保险的完善经验。同时,又对欧美现阶段的专利保险制度进行了对比分析,并在文中列出其不同之处。第二,本文对我国目前的专利保险的实施情况进行了分析,通过资料搜集,对目前专利保险的保险合同以及运作模式进行了详细的分析,并指出现行专利保险制度的优点及亟待改进的部分。第三,本文对专利保险的强制模式、半强制模式及中小企业专利联盟互助保险模式进行了比较分析,并结合我国目前的专利诉讼费用情况进行选择,本文认为我国应选择强制型或者中小企业互助的专利保险模式。第四,通过多方面整体分析,本文为我国专利保险的可持续发展提出了相应的政策建议。. 不足之处,由于专利保险在我国尚处于试点阶段,相应的研究及数据不足,对其研究尚处于理论阶段,未能进行模型研究。同时,由于笔者的能力有限,未能结合法学等学科提出更具体的专利保险实施模式以及相应的专利战略,这方面还有待研究。
[Abstract]:Since the reform and opening - up , our country ' s economy has been developing rapidly . After the financial crisis , all the countries of the world have accelerated the transformation of economy and society . The key to national competition lies in the innovation of science and technology . The patent insurance is one of the important tools for the development of patent in the future .

The general structure of the study is divided into the following main parts :

The first part introduces the research background , the literature review , the content and possible innovations . First of all , with the development of the economic and social development of our country , the research background of this paper is to increase the demand of science and technology innovation and the innovation driving strategy as the core strategy of our country .

The second part comprehensively introduces the basic contents of the patent insurance . It is mainly the meaning of patent insurance , and the main classification method of the patent insurance is divided into patent execution insurance and patent infringement liability insurance , and the differences between the two kinds of patent insurance are introduced , meanwhile , the particularity analysis of the patent insurance compared with the general physical property insurance is also analyzed , and the theoretical basis is provided for the article .

The third part , the innovation driving strategy and the necessity of patent insurance in our country . This chapter mainly introduces the basic connotation of the innovation driving strategy put forward by our country on the 18th Party . Based on the introduction of the innovation driving strategy , the paper analyzes the relationship between the innovation driving strategy and the intellectual property protection in our country . Finally , on the basis of the investigation of the U.S . 337 as an example , the patent litigation and losses of our country in the foreign trade are introduced , and the importance of the patent insurance in our country is highlighted .

In the fourth part , the development patterns of patent insurance in the United States and the European Union are introduced . The development background of patent insurance and the current mode of development are analyzed . For the analysis of the US patent insurance , the paper mainly introduces the intellectual property insurance system of IPISC . In the aspects of the introduction of the European Union patent insurance , the research report of CJA consulting company is mainly analyzed . Finally , the patent insurance of the United States and the European Union is summarized and compared .

The fifth part mainly introduces and analyzes the current situation of the patent insurance in our country , analyzes the current situation of patent insurance in our country by consulting the news and the form of the main function websites . At present , we have carried out the pilot work of the patent insurance in many fields , and promoted the insurance for patent execution . At the present stage , it is the main body of the commercial insurance , the government supports the mode . The pilot work has achieved certain results , but there are still some problems such as single choice , insufficient protection , low participation rate and so on .

The sixth part mainly analyzes the mode of patent insurance in our country , mainly analyzes the compulsory mode , the semi - compulsory mode of the existing patent insurance and the mode of mutual insurance of the patent for small and medium - sized enterprises in the European Union , and analyses the current patent litigation and the patent insurance clauses in our country . In this paper , it is believed that the patent insurance mode of compulsory type or mutual assistance of small and medium - sized enterprises should be introduced , so that the small and medium - sized enterprises can be encouraged to participate in the patent insurance and ensure the application of the law of large numbers .

Part VII , the policy suggestion on the sustainable development of patent insurance in China . This paper holds that the government should provide the patent insurance with a long period of subsidies and good development environment and policy support ;
The insurer shall actively develop a variety of patent insurance products to meet the patent risks of different categories of the patent , and the insurer shall also determine the reasonable assurance level to meet the patent risk protection requirements of different levels of the patent ;
Moreover , in the external environment , it is necessary to perfect our patent evaluation system and patent law service institution , strengthen the patent risk management idea of the enterprise , and establish the appropriate patent risk management strategy .

The eighth part , on the basis of summing up the whole thesis , summarizes the central point of this paper as the conclusion part of this paper .

This paper makes a comparative analysis on the development of patent insurance in Europe and America , analyses the development course of patent insurance in Europe and America , and points out the advantages of patent insurance in Europe and America .

At the same time , due to the limited ability of the author , it is not possible to put forward more specific patent insurance implementation model and corresponding patent strategy in the fields of law , etc .
