企业职务发明奖酬机制研究

【摘要】:随着科技的高速发展,人类社会已经告别传统的工业时代,进入知识经济时代,科技创新已经成为推动社会和经济发展的关键因素。企业作为全球化技术竞争的主体,现代发明创造的主导力量,成为我国技术创新的推动力量。职务发明报酬制度作为职务发明制度的重要组成部分,直接关系到企业与发明人之间的利益分配问题,其本身的科学合理性在很大程度上决定了企业创造和运用知识产权的积极性。我国职务发明奖酬制度散落于各项法规中,无论是从理论基础还是从制度设计角度,都缺乏合理性,随着《职务发明条例(草案)》的公布,职务发明奖酬制度进一步成为社会各界关注的热点。然而,现有理论讨论及制度安排主要站在传统工业领域的角度,与工业时代相适应,较少的考虑知识经济时代的特点,没有考虑到技术领域的新变化。随着科技的发展,人类社会已经开始告别传统的工业经济时代,进入知识经济时代,网络技术、基因技术、电子技术、新材料技术深刻影响着人类社会的发展。专利制度是与科技创新联系最为密切的法律制度,专利制度的建设要顺应技术领域的发展,从而对技术创新起到积极地推动作用。因此,我们应该加快专利制度的创新,适应知识经济时代的新特征。本文通过对国内外文献及相关案例的梳理,分析了强化并提高职务发明人获得报酬比例的理论逻辑漏洞,重新认识现代企业专利资产经营管理过程及专利制度的宗旨。进而指出,现行制度的各项设计与学者的优化建议也并不是围绕通说理论展开的,不仅难以实现利益的均衡分配,在实践中还会将发明人与企业推向对立层面,容易引发纠纷。最后,本文在结合英国、德国、美国等立法技术较高国家相关做法的基础上,建议从理论上重新认识了职务发明人获得报酬权的法律性质,构建职务发明分类体系,探讨合理的发明成果利益分配机制。
[Abstract]:With the rapid development of science and technology, human society has said goodbye to the traditional industrial era and entered the era of knowledge economy. Scientific and technological innovation has become the key factor to promote social and economic development. As the main body of global technology competition and the leading force of modern invention and creation, enterprises have become the driving force of technological innovation in China. As an important part of the job invention system, the compensation system of job invention is directly related to the distribution of interests between the enterprise and the inventor. To a large extent, its scientific rationality determines the enthusiasm of enterprises to create and use intellectual property rights. The system of reward and reward for job inventors in our country is scattered in various laws and regulations, which is lack of reasonableness in terms of both theoretical basis and system design. With the publication of the regulations on Job Invention (draft), The system of job invention award and reward has become the focus of attention from all walks of life. However, the existing theoretical discussions and institutional arrangements mainly stand in the traditional industrial field, adapt to the industrial era, less consider the characteristics of the era of knowledge economy, and do not take into account the new changes in the field of technology. With the development of science and technology, human society has begun to bid farewell to the traditional era of industrial economy, entering the era of knowledge economy, network technology, gene technology, electronic technology, new material technology has a profound impact on the development of human society. Patent system is the legal system which is most closely related to scientific and technological innovation. The construction of patent system should conform to the development of the technical field and thus play an active role in promoting technological innovation. Therefore, we should speed up the innovation of patent system to adapt to the new characteristics of the era of knowledge economy. By combing the domestic and foreign literature and related cases, this paper analyzes the theoretical logic loophole of strengthening and improving the proportion of remuneration to the job inventors, and reunderstands the management process of patent assets and the purpose of patent system in modern enterprises. Furthermore, it is pointed out that the design of the current system and the optimization suggestions of scholars are not carried out around the theory of general theory, which is not only difficult to realize the balanced distribution of benefits, but also pushes the inventor and the enterprise to the opposite level in practice, which can easily lead to disputes. Finally, on the basis of the relevant practices of the United Kingdom, Germany, the United States and other countries with relatively high legislation technology, it is suggested that the legal nature of the right of the duty inventor to receive remuneration should be reunderstood in theory, and the classification system of the job invention should be constructed. To explore a reasonable mechanism for the distribution of benefits of invention achievements.
