中船重工造船企业技术性知识产权的开发方式选择研究

【摘要】：随着国际海事组织（IMO）制定的一系列国际造船新规范、新标准的实施，造船企业在国际国内市场上的竞争越来越激烈，且竞争已由资本、资源和劳动力转向技术含量愈来愈占主导地位的创新技术的竞争。创新技术的竞争，实质上是企业如何运用法律手段与专有手段，合理选择技术性知识产权的开发方式，在不被竞争对手掌握本企业技术的情形下，更好的使其处于市场优势地位的竞争。本文从中船重工造船企业技术性知识产权开发方式选择的角度进行研讨，将国内外关于技术性知识产权开发选择的理论作为基础，对技术性知识产权的开发选择理论进行综述，，从而能够明晰企业进行技术性知识产权开发方式选择的意义，并评述文章的创新点和写作思路。其次，深入分析了造船企业的特点；然后详细阐述了技术性知识产权的开发方式，即专利、专利与技术组合、技术秘密这三种方式及其适用情况；根据已有的理论从企业层面界定了企业技术性知识产权开发方式选择的概念，为后文的研究打下基础。在这个基础上，对中船重工集团及中船重工造船企业进行介绍；接着深入分析中船重工造船企业技术性知识产权开发业绩、存在的问题及其成因，由此引出了下文关于中船重工造船企业技术性知识产权开发方式选择的研究。接着，文章重点研究了企业技术性知识产权开发方式选择因素的确定原则和专利与技术秘密的优劣势比较；根据上述原则和优劣势比较，深入研究企业技术管理、法律环境、行业竞争、技术特征、企业战略五个方面的相关因素对各开发方式选择的影响。运用模糊评价法对中船重工造船企业技术性知识产权开发方式进行评价，并分析组合方式对中船重工造船企业的适用性。针对存在的问题及所选择的开发方式，提出了中船重工造船企业技术性知识产权的开发选择改进对策。
[Abstract]:With a series of new norms and standards of international shipbuilding developed by the International Maritime Organization (IMO), the competition of shipbuilding enterprises in the international and domestic markets has become more and more fierce, and the competition has been made by the capital. Resources and labor force shift to technological content more and more dominant innovative technology competition. The competition of innovative technology is, in essence, how an enterprise uses legal and proprietary means to rationally select the way of developing technical intellectual property rights, without being mastered by its competitors. A better competitive position in the market. In this paper, from the angle of the choice of the development mode of the technical intellectual property rights of the shipbuilding enterprises of China Shipbuilding Industry, taking the theory of the development and selection of the technical intellectual property rights at home and abroad as the basis, the development and selection theory of the technical intellectual property rights is summarized. Therefore, it can clarify the significance of the choice of the development mode of technical intellectual property rights, and comment on the innovation and writing ideas of the article. Secondly, the characteristics of shipbuilding enterprises are analyzed in depth, and then the development methods of technical intellectual property rights, namely patent, patent and technology combination, technology secret and their application are described in detail. According to the existing theories, this paper defines the concept of the choice of the development mode of the enterprise's technical intellectual property right from the enterprise level, which lays the foundation for the later research. On this basis, the paper introduces China Shipyard heavy Industry Group and China Shipyard heavy Industry Shipbuilding Enterprise, and then deeply analyzes the achievements, existing problems and causes of technical intellectual property development of CSI Shipbuilding Enterprises. This leads to the following research on the choice of technical intellectual property rights development mode for shipbuilding enterprises of China Shipyard heavy Industry. Then, the article focuses on the determination of the factors of the choice of the development mode of the enterprise's technical intellectual property rights and the comparison of the advantages and disadvantages of the patent and the technology secret, according to the above principles and the comparison of the advantages and disadvantages, the paper deeply studies the enterprise's technology management and legal environment. The influence of industry competition, technical characteristics and enterprise strategy on the choice of development methods. The method of fuzzy evaluation is used to evaluate the way of developing technical intellectual property rights of shipbuilding enterprises of heavy industry of China Shipyard, and the applicability of combination mode to shipbuilding enterprises of heavy industry is analyzed. In view of the existing problems and the selected development methods, this paper puts forward the countermeasures to improve the development and selection of the technical intellectual property rights of the shipbuilding enterprises of China Shipyard heavy Industry.
