论遗传资源知识产权领域的国家话语权博弈与生态治理能力现代化——兼评《遗传资源知识产权法律问题研究》

【摘要】：随着生态文明的演进,生态利益博弈已成为国家之间竞争与博弈的新领地。借助新型法律制度,如遗传资源知识产权的控制,争夺国家话语权已成重要目标,且已经成为提升与促进国家生态治理能力现代化的重要内涵组成部分。《遗传资源知识产权法律问题研究》从这一视角进行了系统研究。一方面,借助对"遗传资源、生物剽窃"等基础性概念内涵的界定,为遗传资源获取知识产权惠益分配等核心问题的系统探讨奠定前提基础;另一方面,通过探讨传统知识产权保护、遗传资源知识产权惠益分享、遗传资源多样性保护等问题的研究,系统论证了遗传资源领域国家话语权与国家利益。从而在为我国遗传资源知识产权战略配置与对策设计提出建议的同时,也从"遗传资源-知识产权-环境利益调整-国际利益博弈"的思路逻辑层面,为新领域的国家话语权博弈、国家生态治理能力现代化等问题研究提供新视角。
[Abstract]:With the evolution of ecological civilization, the game of ecological interests has become a new territory of competition and game between countries. With the help of new legal systems, such as the control of intellectual property rights of genetic resources, it has become an important goal to fight for the right of the state to speak. It has become an important part of promoting and promoting the modernization of national ecological governance ability. The study on intellectual property Law of genetic Resources is systematically studied from this perspective. On the one hand, with the help of the definition of the basic concepts such as "genetic resources, biological plagiarism" and so on, it lays the foundation for the systematic discussion of the core issues such as the distribution of the benefits of intellectual property rights of genetic resources; on the other hand, Through the study of the traditional intellectual property rights protection, the benefit sharing of genetic resources intellectual property rights and the protection of genetic resources diversity, this paper systematically demonstrates the national discourse rights and national interests in the field of genetic resources. Thus, while putting forward some suggestions for the strategic allocation and countermeasure design of intellectual property rights of genetic resources in China, it is also from the logical level of thinking of "genetic resources-intellectual property rights-environmental interests adjustment-international interest game". It provides a new angle of view for the study of the game of state discourse power and the modernization of national ecological governance ability in the new field.
