中小科技企业专利技术转化问题研究

【摘要】:专利申请数及有效发明专利数等数据集中体现了我国在专利技术转化方面所暴露的问题,,即我国每年有大量的有价值的专利技术呈现了无价值的无限搁置状态,造成了巨大的浪费,使得我国中小科技企业专利转化率低下。因此,为从根本上解决中小科技企业专利技术转化面临的问题,本文以中小科技企业为专门研究对象,针对其专利技术转化率低下,转化速度慢等问题,分行业、分规模、分所处环境,结合法学、管理学、经济学、工程技术学的有关理论,探索、归纳出中小科技企业专利技术转化的三种模式,以法律制度研究为出发点和落脚点,对其进行有针对性,全面详细的研究,优化中小科技企业专利技术转化问题的方案。 中小科技企业专利技术转化模式可以分为创新孵化模式(产品 区域 产业模式)、产业创新平台模式(产业 产品 区域模式)和计划创新引导模式(区域 产业 产品模式)。其中,计划创新引导模式正是比较适合当下我国国情的中小科技企业专利技术转化发展的模式。中小科技企业专利技术转化相关的法律制度可以分为促进合作法律制度、金融扶持法律制度及激励转化法律制度。在这三种法律制度问题分析的基础上,从完善科技中介服务机构法律制度、风险投资法律制度、知识产权激励法律制度方面,解决我国所面临的中小科技企业专利技术转化问题。
[Abstract]:The number of patent applications and the number of effective invention patents have reflected the problems that have been exposed in China's patent technology transformation, that is, there are a large number of valuable patent technologies in our country each year showing an infinite state of uselessness. Caused huge waste, make our small and medium-sized science and technology enterprise patent conversion rate is low. Therefore, in order to fundamentally solve the problems faced by small and medium-sized science and technology enterprises in patent technology transformation, this paper takes small and medium-sized scientific and technological enterprises as the special research object, aiming at the problems of low conversion rate of patent technology and slow conversion speed, and divides them into industries and scales. In the environment, combined with the relevant theories of law, management, economics and engineering technology, three modes of patent technology transformation of small and medium-sized scientific and technological enterprises are summarized, starting and ending with the research of legal system. To conduct a targeted, comprehensive and detailed study, The mode of patent technology transformation of medium and small science and technology enterprises can be divided into innovation and incubation mode (product / region / industry model), industrial innovation platform mode (industry) The regional model of product development and the guiding mode of planning innovation. Among them, the mode of planning innovation guidance is the mode of patent technology transformation and development of small and medium-sized science and technology enterprises which is more suitable for the current situation of our country. The legal system related to patent technology transformation of small and medium-sized scientific and technological enterprises can be divided into legal system of promoting cooperation, legal system of financial support and legal system of encouragement and transformation. On the basis of the analysis of these three legal systems, from the aspects of perfecting the legal system of scientific and technological intermediary service organizations, the legal system of venture capital, the legal system of intellectual property incentives, Solve the problem of patent technology transformation of medium and small science and technology enterprises faced by our country.
