中药饮片炮制技术的专利现状分析与发展策略研究

【摘要】：目的:本研究在对中药饮片炮制技术专利现状研究的基础上,通过在专利检索平台对中药饮片炮制技术相关专利文献进行检索,结合定量研究和定性研究,具体分析专利总体趋势(申请总量,授权量,授权比率),炮制方法专利申请人情况,合作专利申请以及IPC(国际专利分类)分布,结合专利说明书和权力要求书对专利文本信息进一步分析炮制技术专利的技术发展、专利保护范围、专利布局、专利质量等。将专利制度与传统炮制技术的内容结合起来,从专利性的角度出发,研究目前我国中药饮片炮制技术专利保护现状,分析我国炮制技术专利申请的现状及存在问题,以期引起对炮制方法专利的重视,针对我国炮制技术专利的现状与存在的问题,研究炮制技术专利保护策略,为中药饮片炮制技术专利保护提出对策建议。方法:1.文献研究法。通过万方、维普、中国知网(CNKI)等中文期刊网站查阅我国中药饮片炮制技术的发展现状,炮制技术领域知识产权保护现状及存在问题,中医药专利保护等相关文献。了解我国炮制技术领域专利申请状况,专利保护现状,炮制领域研究焦点问题及研究趋势,学习专利检索、专利分析的常用方法,为后续研究的开展奠定理论基础。2.专利检索法。利用广东省专利大数据应用服务系统、国家知识产权局专利检索及分析平台、SOOPAT专利数据库、中国知识产权网等专利数据库进行检索,以关键词作为主要检索手段,获取得到专利信息。将搜集的信息进行汇总,对检索结果进行二次筛选和人工除杂,根据研究需要的指标,对符合条件的专利数据,进行搜索、整理和分析。3.定量分析法。采用EXCEL2007,将数据样本导入,建立炮制专利数据库。本研究针对炮制方法专利申请进行总体申请情况分析、年申请量及授权量趋势分析、主要申请人分析、合作专利申请情况分析、炮制技术领域IPC分类构成以及结合专利文本信息对炮制技术内容等情况进行统计与分析,挖掘炮制方法专利申请状况及专利布局的相关信息。4.定性分析法。利用具体专利说明书,权利要求书等内容,运用数据挖掘等手段归纳整理专利文献信息的内部特征,分析专利技术及其功效间的对应关系,权利要求范围,专利质量、技术发展趋势、发现专利权人技术领域和研发实力,通过内在质的变化来反映技术的发展状况与发展趋势。结果:通过对炮制技术专利申请状况进行分析,得出如下结果:炮制方法专利申请量较少,授权率不高;大专院校、科研院所的研发优势未能充分发挥,合作专利较少。以成都中医药大学和济南康众医药科技开发有限公司为例,对两所单位专利保护状况进行分析,专利的技术内容上看,成都中医药大学在研发实力、专利质量、专利布局、专利保护等方面实力较强,济南康众医药科技开发有限公司在中药饮片炮制技术领域的专利申请缺乏新颖性和创造性,专利质量低,涉及专利保护的范围较小,研发实力不强。从整体上看,近年来炮制技术领域仍处于较好的发展时期,专利申请量呈现逐年递增的情况,但仍面临着授权率低,专利质量不高、市场导向不强等问题。结论:目前,我国中药饮片炮制技术领域专利保护存在的问题如下:炮制技术并行的专利保护和行政保护制度在实践中存在冲突;炮制技术专利新颖性和创造性不高导致专利质量低下;专利申请文件的撰写水平还有待提高;大专院校和科研院所的研发实力还没有充分发挥;专利的市场转化率较低,产学研联合还不够深入;专利布局不合理等。针对上述问题,从宏观上讲要相关政策法规的制定以及配套细则的完善,加强对大专院校和科研院所的引导,构建产学研联盟提高专利转化率,完善对中医药领域专利审查标准,提高专利文件撰写水平。从炮制方法专利保护看,应当结合新技术,采用新设备,依靠创新提升炮制技术竞争力;将炮制专利技术从传统配伍转变为化学溶出的研究;对中药炮制技术进行二次开发,拓宽炮制技术专利申请的领域;对需要涉及重大意义需要保密的专利进行保密专利申请;合理结合中药品种保护和专利保护,制定中药保护的立体保护策略。
