中日技术调查官制度比较研究

【摘要】：技术调查官制度的实施是知识产权专门法院所进行的一项重要司法审判改革,也是最高人民法院在《关于在北京、上海、广州设立知识产权法院的决定》实施满三年后向全国人民代表大会常务委员会报告决定实施情况的重要组成部分。论文以技术调查官制度为考察对象,详细比较中国和日本技术调查官制度的基本内容及实施情况,分析我国技术调查官制度实施中存在的问题并提出相应的完善建议,认为应由最高人民法院统一制定关于技术调查官的工作规范和管理选拔办法,避免技术调查官制度在不同知识产权法院实施中出现差异,从而影响技术调查官作为司法辅助人员的中立性和权威性。
[Abstract]:The implementation of the system of technical investigators is an important judicial reform carried out by the specialized intellectual property courts, and it is also the Supreme people's Court in Beijing, Shanghai, The decision to set up an intellectual property Court in Guangzhou is an important part of reporting the implementation of the decision to the standing Committee of the National people's Congress three years after its implementation. Taking the technical investigator system as the object of investigation, this paper compares in detail the basic contents and implementation of the technical investigator system in China and Japan, analyzes the problems existing in the implementation of the technical investigator system in China and puts forward corresponding suggestions for perfection. Considering that the Supreme people's Court should uniformly formulate the rules for the work of technical investigators and the measures for their management and selection, so as to avoid differences in the implementation of the system of technical investigators in different intellectual property courts, Thus affecting the technical investigation officer as a judicial assistant personnel neutrality and authority.
