【摘要】:当今的世界是科技的世界,掌握了先进科技的国家必定走在世界的前列。而衡量先进技术的标准就在于该国职务发明的质量与数量,而我国的职务发明无论在质量上,还是在数量上都与世界发达国家有较大差距。另外我国职务发明总量占发明总量的比例一直低于欧美等发达国家,该现象背后的原因是多种多样的,但法律制度上的缺陷不容忽视。职务发明报酬制度作为职务发明制度的重要一环,其本身的完善与否很大程度上决定了一国科技水平的高低。目前,该制度虽已初步实现对职务发明人,设计人的权益保护,但仍存在保护范围不够广,保护力度不够强,保护措施不够及时等问题,若能在现有基础上进一步完善,对我国科技创新水平的提升将大有裨益。 本文总共分为五章,从职务发明法律制度的由来谈起,并通过一系列的理论研究和案例研究,最终对职务发明报酬制度的完善给出较为全面的建议,内容大致如下: 第一章,职务发明法律制度概述。从明确职务发明制度的概念,追溯职务发明制度的由来入手引出职务发明报酬制度这一概念,再简单介绍我国职务发明报酬制度的产生与发展,同时廓清职务发明报酬与科技奖励之间的界限,最后通过引用专利统计年报,对完善职务发明报酬制度的意义进行深入思考。 第二章,职务发明报酬制度理论基础和历史比较。前半章通过对现今职务发明报酬性质的学说进行比较分析,否定了“债权客体说”与“劳动报酬说”,进而指出“知识产权说”合理之处。后半章则从历史的维度将《专利法》和《专利法实施细则》中有关职务发明报酬制度的条文进行比较,发现其中积极进步之处。 第三章,国外职务发明报酬制度和对中国的启示。对美国的0TL模式,德国的《雇员发明法》,日本的《特许法》等内容进入深入探究,并结合我国的立法现状,得出世界优秀法律制度对中国的启示。 第四章,我国职务发明报酬给付现状。通过对三个典型案例的思考,发掘出我国现行制度实施与运行存在的问题,主要表现为法律法规在制定上存在空白,法律法规虽有制定但有欠缺,单位员工维权意识淡薄和工会力量薄弱无力这四方面。 第五章,我国职务发明报酬制度的完善。在全文的研究基础上,对我国职务发明报酬制度的完善提出系统性的建议。首先,需要从理论上准确认知职务发明报酬权,即知识产权;然后,从规范法律用语,设定合理报酬提取比例,丰富统一报酬支付方式和健全报酬计算方法这四个方面提出立法建议;最后,还应从完善相关配套制度的角度来促进法律制度的实施。
[Abstract]:Today's world is the world of science and technology, the country with advanced technology must be in the forefront of the world. The standard of measuring advanced technology lies in the quality and quantity of the job invention in our country, and the quality and quantity of the job invention in our country are far from those of the developed countries in the world. In addition, the proportion of the total number of job inventions to the total number of inventions in China has been lower than that of developed countries such as Europe and the United States. The reasons behind this phenomenon are various, but the defects in the legal system should not be ignored. As an important part of the duty invention system, the compensation system of duty invention determines the level of science and technology of a country to a great extent. At present, although the system has preliminarily realized the protection of the rights and interests of job inventors and designers, there are still some problems, such as the scope of protection is not wide enough, the intensity of protection is not strong enough, and the protection measures are not timely enough. If the system can be further improved on the existing basis, It will be of great benefit to the improvement of the level of scientific and technological innovation in our country. This article is divided into five chapters, starting from the origin of the legal system of job invention, and through a series of theoretical studies and case studies, finally gives more comprehensive recommendations on the perfection of the compensation system of job invention, the content of which is as follows: The first chapter is an overview of the legal system of duty invention. The concept of the compensation system of duty invention is introduced from the definition of the system of duty invention, the origin of the system of duty invention is traced back, and the emergence and development of the reward system of duty invention in our country are briefly introduced. At the same time, the paper clarifies the boundary between the reward of duty invention and the reward of science and technology. Finally, by citing the annual report of patent statistics, the significance of perfecting the reward system of duty invention is deeply considered. The second chapter, the theoretical basis and historical comparison of the compensation system of duty invention. In the first half of this chapter, the author makes a comparative analysis of the nature of compensation for present duty inventions, denies the "object of creditor's rights" and "labor remuneration", and then points out the reasonableness of "intellectual property right theory". The latter part compares the articles of Patent Law and the detailed rules of Patent Law about the compensation system of duty inventions from the historical dimension, and finds out the positive progress in the articles. The third chapter, the compensation system of foreign duty invention and its enlightenment to China. The contents of American 0TL model, German employee's invention law and Japan's charter law are deeply explored, and the enlightenment of the world's excellent legal system to China is obtained by combining the current legislative situation of our country. The fourth chapter, our country duty invention reward payment present situation. Through the thinking of three typical cases, the problems existing in the implementation and operation of the current system of our country have been discovered. The main manifestation is that there are gaps in the formulation of laws and regulations, although the laws and regulations are formulated, they are deficient. Unit employees weak awareness of the rights and weak trade unions in these four areas. The fifth chapter, our country duty invention reward system consummation. On the basis of the research, the paper puts forward systematic suggestions on the perfection of the compensation system of duty invention in our country. First of all, we need to recognize the right to compensation for job inventions in theory, that is, intellectual property rights, and then, from the perspective of regulating legal terms, to set a reasonable proportion of remuneration to be drawn. Finally, it is necessary to promote the implementation of the legal system from the angle of perfecting the relevant supporting system.
