我国高校专利转化的现状、问题及对策研究

【摘要】：摘要：在市场经济和科学技术不断发展的今天,专利申请量的多少、质量的高低及产业化程度已成为衡量各国技术创新能力、经济竞争能力的重要指标。调查研究表明,高校因其具有学科、人才、信息和学术环境等优势,发挥着知识产权生产和科技创新主力军的作用。加强高校知识产权保护,能够增强高校科研人员的积极性,同时促进科技成果的产业化。由于我国高校盲目追求专利申请量,并未建立起完善的专利转化法律政策体系,在专利投资融资、产学研合作机制建设、科技中介服务能力方面都存在许多不足,造成高校专利申请量大,质量不高,弃权现象严重,转化率低。高校专利转化现状的改变需要国家法律政策体系的完善,同时也需要高校专利管理方式的改革。在此,通过对国内高校专利转化现状进行实证分析,提出我国高校在专利转化工作中存在的问题,指出阻碍我国高校专利转化的原因,在借鉴发达国家高校专利转化经验基础上,从国家法律政策层面和高校专利转化服务层面来分析解决我国高校专利转化难题的对策,如界定高校专利权利归属、完善高校专利转化的保障和利益分配机制、建立产学研合作的长效机制、健全专利转化投融资机制、加强高校专利转化中介服务能力、提高高校专利转化管理水平等。
[Abstract]:Absrtact: with the development of market economy and science and technology, the quantity, quality and industrialization of patent application has become an important index to measure the technological innovation ability and economic competition ability of various countries. The investigation shows that universities play the role of the main force of intellectual property production and scientific and technological innovation because of their advantages of discipline, talent, information and academic environment. Strengthening the protection of intellectual property rights in colleges and universities can enhance the enthusiasm of researchers and promote the industrialization of scientific and technological achievements. Because of the blind pursuit of patent application by colleges and universities in our country, the legal policy system of patent transformation has not been established, and there are many deficiencies in patent investment and financing, the construction of cooperation mechanism between industry, university and research, and the ability of scientific and technological intermediary service. As a result, colleges and universities patent application volume is large, the quality is not high, the phenomenon of abstention is serious, the conversion rate is low. The change of the status quo of patent transformation in colleges and universities requires the perfection of the national legal policy system and the reform of the patent management mode in colleges and universities. Based on the empirical analysis of the status quo of patent transformation in colleges and universities in China, this paper points out the problems existing in the patent transformation of colleges and universities in China, and points out the reasons that hinder the patent transformation in colleges and universities in China. Based on the experience of university patent transformation in developed countries, this paper analyzes the countermeasures to solve the problem of patent transformation from the aspects of national law and policy and university patent transformation service, such as defining the ownership of patent rights in colleges and universities. It is necessary to perfect the mechanism of protection and benefit distribution of patent transformation in colleges and universities, to establish a long-term mechanism of cooperation between industry, college and research, to perfect the mechanism of investment and financing of patent transformation, to strengthen the ability of intermediary service for patent transformation in colleges and universities, and to improve the management level of patent transformation in colleges and universities.
