论商业外观中知名商品的法律保护

【摘要】:随着我国市场经济的不断发展以及全球贸易的日益发达,有关知名商品的保护已经成为世界各国不容忽视的一个问题。不法商家在商业活动当中仿冒知名商品的“搭便车”行为也日益猖獗。此种模仿行为不仅仅会对知名商品本身造成恶劣的影响,也会在社会大众之间造成混淆。因此,为了构造一个良好的商业竞争环境,保护企业的商业成果以及消费者的切身利益,如何为知名商品提供更好的法律保护是我国所面对的重要问题。本文共分为五章:在第一章中,笔者主要论述了知名商品的定义、知名商品的保护范围、知名商品的特征以及保护知名商品的现实意义;第二章笔者介绍了知名商品同我们传统意义上知识产权的区别,并从理论和现实层面论述了保护知名商品的原则;第三章是比较法研究,笔者通过对国际条约、美国、日本、韩国和德国等发达国家相关法律的研究,分析了其在立法层面值得我国借鉴的优势之处;第四章论述了知名商品在我国保护的现状,比如如何认定商品的“知名性”以及关于混淆的界定,并阐述我国现阶段在保护知名商品方面有哪些的不足,提出了自己的见解。通过以上的论述,笔者认为,加强对知名商品的保护力度范围不仅可以维护一个良好的市场秩序,而且还能够更加有效的解决各知识产权权利之间的冲突。同时,为提高我国在国际竞争中的形象也有着不可忽视的作用。
[Abstract]:With the development of China's market economy and the development of global trade, the protection of well-known commodities has become a problem that can not be ignored in the world. Illegal merchants in commercial activities counterfeit famous goods, "hitchhiking" behavior is increasingly rampant. This kind of imitation will not only have a bad effect on the famous goods themselves, but also cause confusion among the public. Therefore, in order to construct a good commercial competition environment, to protect the business achievements of enterprises and the vital interests of consumers, how to provide better legal protection for well-known commodities is an important problem facing our country. This paper is divided into five chapters: in the first chapter, the author mainly discusses the definition of well-known goods, the scope of protection of well-known goods, the characteristics of well-known goods and the practical significance of protecting well-known commodities; In the second chapter, the author introduces the differences between well-known goods and our traditional intellectual property rights, and discusses the principles of protecting well-known goods from the theoretical and practical aspects. Chapter three is a comparative law study, the author through the international treaties, the United States, Japan, South Korea and Germany and other developed countries related law research, analyzed its legislative level worthy of our country to learn from the advantages; the fourth chapter discusses the status quo of well-known goods in China, For example, how to identify the "well-known" of goods and the definition of confusion, and explain what are the deficiencies in the protection of well-known commodities in our country at this stage, and put forward their own views. Through the above discussion, the author believes that strengthening the scope of protection of well-known commodities can not only maintain a good market order, but also more effectively solve the conflict between intellectual property rights. At the same time, in order to improve the image of our country in the international competition also plays an important role.
