我国商业外观保护的法律问题研究

【摘要】:商业外观起源于美国,其并没有一个准确的定义。在美国等西方国家,商业外观早就已经纳入法律中进行保护。在我国国内对商业外观法律保护有所需求的情况下,现行知识产权以及反不正当竞争法对商业外观保护的规定已经不能够给我国商业外观以有力的保护。且众多法律规定对商业外观的交叉保护和商业外观尚未明确的性质使得我国对商业外观的保护始终处于一个比较有限的水平。我国企业在对外进行相关贸易活动中不能得到有关商业外观方面法律的完整保护,以致于企业价值最大化目标不能实现,最终也有损我国国际竞争力,不利于我国引进先进技术和流动性更强的资本。与此同时,商品和服务外观保护制度的不完善,也不利于中国国内市场的发展。所以,我们应该加大对商业外观研究的力度,只有这样才能使我国企业对外的发展和交流中,不再处于弱势地位,使商业外观制度能够维持我国企业在国际上的竞争力并且保护国内良好的竞争秩序。本文系统阐释了对商业外观进行研究的意义和背景,总结了国内外学者观点。并在此基础上探究了商业外观基本理论,分析了商业外观的含义及对其进行法律保护的可能性,从多角度分析了我国商业外观保护的必要性。进而提出了我国商业外观保护存在的法律问题,研究并借鉴了美国在商业外观保护方面的先进经验。最终提出了在我国对商业外观进行保护的建议。
[Abstract]:Commercial appearance originated in the United States, and it does not have an accurate definition. In Western countries, such as the United States, commercial appearance has long been protected by law. Under the circumstance of our country's domestic demand for the legal protection of the commercial appearance, the current intellectual property rights and the provisions of the anti-unfair competition law on the protection of the commercial appearance can no longer give our country a strong protection of the commercial appearance. And many laws and regulations on the cross-protection of the commercial appearance and the nature of the commercial appearance has not been clear that the protection of the commercial appearance in China has always been in a relatively limited level. Chinese enterprises can not get the complete protection of the law on the commercial appearance in their foreign trade activities, so that the goal of maximizing the value of enterprises can not be realized, which will ultimately damage the international competitiveness of our country. It is unfavorable for China to introduce advanced technology and more liquid capital. At the same time, the imperfect system of protecting the appearance of goods and services is not conducive to the development of China's domestic market. Therefore, we should strengthen the research on the commercial appearance. Only in this way, can our enterprises no longer be in a weak position in the development and exchange of foreign countries. So that the commercial appearance system can maintain the international competitiveness of Chinese enterprises and protect the domestic good competition order. This paper systematically explains the significance and background of the research on commercial appearance and summarizes the views of domestic and foreign scholars. On this basis, this paper probes into the basic theory of commercial appearance, analyzes the meaning of commercial appearance and the possibility of its legal protection, and analyzes the necessity of commercial appearance protection in China from various angles. Then it puts forward the legal problems existing in the protection of commercial appearance in our country, and studies and draws lessons from the advanced experience of the United States in the protection of commercial appearance. Finally, the suggestion of protecting the commercial appearance in our country is put forward.
