IT市场信息落差牟利行为的法律规制

【摘要】:随着现代科技的迅猛发展,人类生活日益数字化、虚拟化,置身科技大潮中的我们很可能面临知识严重滞后从而不能有效适应数字化变革的被动局面。这样的问题反映到消费领域特别是高科技产品消费领域就更加明显,我们大多数人都可能已经沦为“信息落差”的利益损失者。 本文所指的信息落差牟利行为,是指以IT市场为代表的高新技术市场中的生产商、中介商以及最终经销商,利用客观存在的信息落差,或人为制造、夸大这一落差,即利用或人为制造电子产品的“技术性”、“专业性”与买家消费知识的“有限性”、“滞后性”之间的时空差异,而牟取不当商业利益的欺诈行为。 简言之,IT市场信息落差牟利行为的本质是,不良经销商利用买卖双方的“IT市场信息落差”而实施的商业欺诈行为。 IT市场信息落差牟利行为的产生原因有:第一,商家“商业利润最大化”的本能驱使。第二,消费者缺乏专业消费知识,具体包括计算机专业知识及法律知识。 IT市场信息落差牟利行为的类型有:第一,,经营者之间恶意串通而实施的信息落差牟利行为。第二,经营者利用产品之间的性能差异而实施的信息落差牟利行为。第三,经营者利用价格行情而实施的信息落差牟利行为。第四,经营者借助包装而实施的信息落差牟利行为。第五,经营者通过“偷换概念”的方式实施的信息落差牟利行为。 IT市场信息落差牟利行为的违法性在于:首先,该行为违反了消费者权益保护法。不仅侵犯了消费者的知情权,也侵犯了消费者的自主选择权。其次,违反了广告法及反不正当竞争法,最后也违反了知识产权法。 要对“IT市场信息落差牟利行为”进行法律规制,主要从两个层面做起,第一,“自律”层面,消费者与经营者都应增强法律意识,这就不但要求消费者要提高自我保护意识,也要求经营者要强化诚信经营意识。第二,“他律”层面,国家应依法加强市场监管。
[Abstract]:With the rapid development of modern science and technology, human life is becoming more and more digital and virtualized. In the tide of science and technology, we are likely to face the passive situation of serious lag of knowledge and can not effectively adapt to digital change. Such problems are even more evident in the consumer sector, especially in the area of high-tech consumption, where most of us may have become losers from the "information gap". The information gap in this paper refers to the producers, intermediaries and final dealers in the high-tech market represented by the IT market, using the objective information gap, or artificially manufacturing, to exaggerate the gap. That is to say, the space-time difference between "technical", "professional", "limited" and "lag" of consumer knowledge between the use or artificial manufacture of electronic products, and the fraudulent behavior of obtaining improper commercial benefits. In short, the essence of the behavior of making profits from the information drop in the IT market is that the bad dealer uses the "IT market information gap" between the buyer and the seller to carry out commercial fraud. The reasons for the profit-making behavior in the IT market information fall are as follows: first, Business "business profit maximization" instinct driven. Second, consumers lack professional consumer knowledge, including computer expertise and legal knowledge. Secondly, the operator makes use of the performance difference between the products to make profit from the information drop. Third, operators use the price market and the implementation of the information gap for profit. Fourth, the operator with the help of packaging and the implementation of the information gap and profit-making behavior. Fifthly, the operators' behavior of making profits by "changing the concept of information". The illegality of the behavior of making profits by information drop in IT market lies in: first, the behavior violates the law of consumer rights and interests protection. Not only infringes the consumer's right to know, but also infringes on the consumer's right to choose. Secondly, it violates the advertising law and anti-unfair competition law, and finally violates the intellectual property law. In order to regulate "the behavior of making profits from the information gap in IT market", we should mainly start from two levels. First, at the level of "self-discipline", both consumers and operators should enhance their legal awareness, which not only requires consumers to enhance their awareness of self-protection. Also requires the operator to strengthen the good faith management consciousness. Second, "heteronomy" level, the state should strengthen market supervision according to law.
