保险产品的知识产权保护研究

【摘要】:保险产品是保险行业赖以发展的核心要素。目前学界对保险产品内涵的界定尚无统一定论,主要有“无形服务商品论”、“消费者补偿论”、“金融衍生品论”和“产品层次论”四种观点。结合学界理论和保险实务,保险产品是保险公司为市场提供的有形产品和无形服务的综合体,,具体可以从核心产品维度、形式产品维度和拓展产品维度三个维度理解保险产品的整体内涵。与其他产品相比,保险产品具有四个特殊属性,即保险产品是特殊而复杂的商品,是抽象的无形商品,是非渴求性的消费品,是具有较强异质性的商品。 保险产品的创新与开发是个复杂的系统工程。开发一款新型产品,保险公司要遵循合法性、市场性、效益性、标准化等原则,要经过市场调研、产生创意方案、对创意方案进行综合评估、进行产品的技术设计和产品报备审批等诸多环节,付出诸多的创造性智力劳动。因此,作为一种具有社会性、公开性、创造性和非物质性的知识产品,保险产品应当属于知识产权的客体之一,理应受到法律保护。从理论探讨的角度看,公平正义原理、劳动财产权理论、激励理论和公共产品理论都能为保险产品这项创造性智力劳动成果的知识产权保护提供理论支撑。 目前,我国保险产品的知识产权保护几乎是空白,使得保险同质化同构化严重。因此,加强保险产品知识产权保护是非常有必要的,对保险公司和保险行业都有重要的现实意义。在我国现行法律框架下,保险产品的知识产权可以受到《著作权法》、《专利法》、《商标法》、《反不正当竞争法》等法律保护。在著作权保护模式下,因受思想与表达二分法原则和独创性原则的限制,保险产品著作权保护存在一定不足,但仍可以进行积极的制度构建予以弥补,具体包括明确保险产品是法定作品、明确保险产品著作权的内容、明确保险产品著作权保护主体及其职责、合理设置保险产品著作权保护期限、明确保险产品著作权侵权行为认定标准、制定保险产品著作权登记规范。在专利保护模式下,对保险产品主要是以商业方法专利形式予以保护,但目前我国对保险产品商业方法专利的保护持谨慎严格的态度。新形势下我国应积极构建适合我国国情的商业方法专利保护制度,同时中资保险公司也应加强保险产品商业方法的保护。另外,商标保护模式和商业秘密保护模式也是保险产品知识产权保护方式的有益补充。
[Abstract]:Insurance products are the core elements of the development of the insurance industry. At present, there is no unified definition of the connotation of insurance products in academic circles. There are mainly four viewpoints: "Intangible Service Commodity", "Consumer compensation", "Financial Derivatives" and "Product hierarchy". Combined with academic theory and insurance practice, insurance products are a combination of tangible products and intangible services provided by insurance companies for the market. Form product dimension and expand product dimension three dimensions to understand the overall connotation of insurance products. Compared with other products, insurance products have four special properties, that is, insurance products are special and complex commodities, abstract intangible goods, non-desirable consumer goods, and strongly heterogeneous goods. The innovation and development of insurance products is a complex system engineering. To develop a new type of product, insurance companies should abide by the principles of legitimacy, marketability, efficiency, standardization, and so on. After market research, they should produce creative plans and conduct a comprehensive evaluation of creative schemes. Carry on the technical design of the product and the examination and approval of the product report, and pay a lot of creative intellectual labor. Therefore, as a kind of knowledge product with sociality, openness, creativity and immateriality, insurance products should belong to one of the objects of intellectual property rights and should be protected by law. From the theoretical point of view, the principle of fairness and justice, the theory of labor property rights, the theory of incentive and the theory of public goods can provide theoretical support for the intellectual property protection of the creative intellectual labor achievement of insurance products. At present, the intellectual property protection of insurance products in our country is almost blank, which makes the insurance homogenization and isomorphism serious. Therefore, it is necessary to strengthen the intellectual property protection of insurance products, which is of great practical significance to insurance companies and insurance industry. Under the current legal framework of our country, the intellectual property rights of insurance products can be protected by such laws as copyright Law, Patent Law, Trademark Law, Anti-unfair Competition Law and so on. In the mode of copyright protection, due to the limitation of the dichotomy of thought and expression and the principle of originality, the protection of the copyright of insurance products has some shortcomings, but it can still be compensated by the positive system construction. Specifically, it includes making clear that the insurance product is a legal work, clarifying the content of the copyright of the insurance product, clarifying the subject of the copyright protection of the insurance product and its responsibilities, and setting up a reasonable period for the protection of the copyright of the insurance product. Define the standards of copyright infringement of insurance products and establish the registration standard of copyright of insurance products. In the mode of patent protection, insurance products are mainly protected in the form of commercial method patents, but at present our country has a cautious and strict attitude towards the protection of business method patents of insurance products. Under the new situation, our country should actively construct the patent protection system of commercial methods suitable for the national conditions of our country, and at the same time, the Chinese insurance companies should also strengthen the protection of the commercial methods of insurance products. In addition, trademark protection mode and trade secret protection mode are also a beneficial supplement to intellectual property protection of insurance products.
