计算机软件可专利性问题研究

【摘要】:计算机软件的知识产权保护是人们讨论的热点,同时也是个难点,对此问题学术界有不同观点,世界各国有不同的做法。目前世界上流行的做法是将软件视为作品给予版权保护,然而软件毕竟不同于传统文学作品,在大多数情况下它是作为一种工具而存在,因此给予计算机软件以专利保护便成为讨论的热门话题。 本文分为四个部分,旨在通过分析计算机软件自身的特点,论证其可专利性。第一部分首先介绍了计算机软件的概念和特点,然后介绍了欧洲和美国对于计算机软件的专利保护以及对于我国的启示。第二部分从计算机软件的工具性角度出发,认为首先软件本身可以成为一种技术方案,其次软件不同于数学公式和思维方法,不属于智力活动的规则和方法,应当能够成为专利法所保护的对象。第三部分意在讨论软件专利的审查标准与普通专利相比有何不同,就实用性、新颖性和创造性分别展开论述,思考其实质性授权条件。大多数软件都具有实用性,判断新颖性的关键在于如何认定现有技术以及相应数据库的建立,而创造性成为软件取得专利的最后门槛。第四部分就如何完善我国专利法关于计算机软件的保护提出了几点建议,认为首先应当承认软件本身是专利法所保护的客体,其次在此基础上采取宽进严出的审查策略以控制软件专利的数量,同时缩短软件专利的审查期限和保护期限,再次为了使软件本身能够申请产品发明专利还需要扩大产品这一概念在专利法下的含义,最后建议申请专利时要求开发者公开源代码。
[Abstract]:The intellectual property protection of computer software is not only a hot topic but also a difficult one. There are different viewpoints in academic circles and different ways in the world. The prevailing practice in the world at present is to treat software as a work that gives copyright protection, but software is, after all, different from traditional literature, and in most cases it exists as a tool. Therefore, giving computer software patent protection has become a hot topic of discussion. This paper is divided into four parts, aiming to prove the patentability of computer software by analyzing its own characteristics. The first part introduces the concept and characteristics of computer software, and then introduces the patent protection of computer software in Europe and America and the enlightenment to our country. In the second part, from the perspective of the instrumentality of computer software, it is considered that, firstly, software itself can become a technical scheme, and secondly, the software is different from mathematical formulas and thinking methods and does not belong to the rules and methods of intellectual activities. It should be able to be protected by patent law. The third part is to discuss the difference between the examination standard of software patent and that of common patent, discuss the practicability, novelty and creativity respectively, and think about the substantive authorization condition of software patent. Most software are practical, the key to judge novelty lies in how to identify the existing technology and the establishment of the corresponding database, and creativity becomes the final threshold of software patent. The fourth part puts forward some suggestions on how to perfect the protection of computer software in the patent law of our country, and thinks that the software itself should be recognized as the object protected by the patent law. Secondly, on the basis of this, we adopt a wide and strict examination strategy in order to control the number of software patents, and at the same time shorten the period of examination and protection of software patents. Thirdly, in order to make the software itself able to apply for product invention patent, it is necessary to expand the meaning of the concept of product under patent law. Finally, it is suggested that the developer be required to open the source code when applying for patent.
