电子垃圾邮件所引发的个人权益问题及法律管制

【摘要】:随着计算机的发展和信息时代的到来,网络日益影响并改变着人们的行为和生活方式。它在提供便利的同时也给权利保护带来了严峻挑战,最典型的例子就是垃圾电子邮件的横行。电子邮件作为互联网最早同时也是最普遍的联络方式,以其快速、高效及兼容多元、容量大等特点成为人们在互联网中使用最广泛的交流方式。但其带来的负面效应也在广受欢迎的同时渐渐凸显,电子垃圾邮件大量涌现已成为网络问题的重中之重。垃圾邮件充斥网络世界,造成网络系统的紧张和网络资源的浪费,并可能引爆电子邮箱,耗费人们的宝贵时间和金钱。因此,合理规制电子邮件的发送,保护公民隐私,势在必行。 本文主要运用比较分析和实证研究的方法,通过对垃圾邮件背景知识的梳理,借鉴国内外相关制度的比较以及目前我国立法现状产生的问题进行分析,提出加强网络服务供应商在这一方面所能起到的作用,以期为我国建立独立完善的反垃圾邮件法律管制体系提供一些具有操作性的思路和建议。 首先,本文论证了垃圾邮件从得到发送对象的个人信息时已构成侵犯隐私权行为,而从发送的后果来看也给网络用户带来了财产、知识产权及其他权益的侵害。对垃圾邮件的产生背景、运行机制进行了阐释,指出了反垃圾邮件的重要性。其次,结合国内外立法现状并进行对比,找出现行立法状况的不足,进而分析了反垃圾邮件的有效突破口。提出由网络服务供应商有义务也有能力对其运营的邮件服务进行管制。本文在对国内外反垃圾邮件现状及处理模式的调查分析的基础之上,客观地描述了我国在处理垃圾邮件存在的问题,并着重分析了网络服务供应商在反垃圾邮件中的作用和义务,最后提出了加强网络运营商的监管作用和规范以建立完善独立并且有效的反垃圾邮件机制。分别从网络运营商在处理垃圾邮件的技术优势、责任义务、具体措施及对网络运营商的监管和反垃圾邮件法律管制的构建等多个角度提出了具体完善的建议,为完善我国反垃圾邮件的制度建言献策。
[Abstract]:With the development of computer and the arrival of information age, the network is increasingly influencing and changing people's behavior and way of life. While facilitating, it poses a serious challenge to the protection of rights, the most typical example of which is the prevalence of spam. As the earliest and most common way of communication on the Internet, email has become the most widely used communication method in the Internet because of its rapidity, efficiency, compatibility and diversity, large capacity and so on. However, the negative effects are becoming more and more popular, and the emergence of e-spam has become the most important problem in the network. Spam flooded the network world, resulting in the tension of the network system and the waste of network resources, and may detonate the email, and waste people's precious time and money. Therefore, it is imperative to regulate the sending of e-mail and protect the privacy of citizens. This paper mainly uses the method of comparative analysis and empirical research, through combing the background knowledge of spam, drawing lessons from the comparison of relevant systems at home and abroad and the problems arising from the current legislative situation in China. This paper puts forward the role that network service providers can play in this respect, in order to provide some operable ideas and suggestions for the establishment of independent and perfect anti-spam legal control system in China. First of all, this paper demonstrates that spam has violated the right of privacy when it gets the personal information of the sending object, and it also brings property, intellectual property and other rights and interests to network users from the result of sending. The background and operating mechanism of spam are explained, and the importance of anti-spam is pointed out. Secondly, combined with the domestic and foreign legislative status and compared, find out the shortcomings of the current legislative situation, and then analyze the effective breakthrough of anti-spam. It is proposed that network service providers have the obligation and ability to regulate mail services they operate. Based on the investigation and analysis of the current situation and handling mode of anti-spam at home and abroad, this paper objectively describes the existing problems in dealing with spam in China. The role and obligation of network service providers in anti-spam are analyzed emphatically. Finally, it is proposed to strengthen the supervision and regulation of network operators in order to establish an independent and effective anti-spam mechanism. From the network operators' technical advantages in dealing with spam, responsibility and obligations, specific measures and network operators to regulate and anti-spam legal control and other aspects of the construction of specific and perfect suggestions.
