审查制度下境外电影作品的版权保护

【摘要】:电影作品,因为其独特的艺术魅力,不仅丰富了人们的娱乐生活,而且也成为世界各个国家展示文化底蕴的方式和促进文化交流的纽带。最典型的例子就是,美国利用好莱坞电影的巨大影响力成功地向世界展示和宣传了自己的文化价值和社会理念。改革开放之后,我国的经济水平得到了极大的提高,,国际化逐步加强,人们在满足物质需求之后对精神文化生活的要求也越来越高,因此越来越多的境外电影作品进入到国内市场。但是由于审查制度的存在,境外电影作品在进入我国市场的过程中总会遇到层层限制。于是在科技高速发展的时代,很多境外电影作品通过互联网等方式进入到我国,从而逃脱了电影审查这一环节,从而造成了诸多侵害境外电影版权的现象。然而我国修改之前的《著作权法》第4条规定“依法禁止出版、传播的作品,不受本法保护”,也就意味着未通过、未经过审查的境外电影作品的版权在我国得不到保护。针对这种情况,美国于2007年向WTO提出了抗议,进而中美之间就知识产权方面产生了又一次争端,即我们所熟知的“DS362案”。 本文第一部分,通过对“DS362案”的来龙去脉、争议焦点以及专家组的裁决结果等方面进行分析,得出了我国目前在境外电影版权保护方面存在的最主要的两个问题:(一)涉及到内容审查的电影审查制度是否应该被废除(二)《著作权法》第4条的修改背景以及修改后的《著作权法》第4条在有关未通过、未经过审查的境外电影作品版权保护方面的缺失。 第二部分,针对“DS362案”所引起的电影审查制度的存废问题展开论述。在了解、分析电影审查制度特点的过程中发现其优缺点,为完善电影审查制度提出明确指向,并通过对比电影分级制度以及分析国际法规论证了电影审查制度存在的合理性。 第三部分,围绕“DS362案”所引发的第二个问题:即修改后的《著作权法》第4条在保护境外电影作品版权方面的不足展开。从《伯尔尼公约》的相关规定、《著作权法》的修改背景、电影审查制度的缺陷三个方面论证了未通过审查的境外电影作品依然享有限制性的著作权。 第四部分,通过对《伯尔尼公约》等国际条约和美国在保护境外电影作品版权方面规定的分析,旨在引出我国应该设立一套与国情相符合的境外电影作品版权保护制度,而不能盲目参考国外尤其是美国在电影版权方面的规定。 正文的最后主要包括以下几个部分:(一)针对电影审查制度存在的不足,建议在其中加入临时性保护措施和事后审查机制。(二)通过对电影版权具体权利内容的分析,将其分为“与传播无关的权利”和“与传播有关的权利”,明确了未通过审查的境外电影作品的版权认可方式,即未通过审查的境外电影作品享有“与传播无关的权利”,但在“与传播有关的权利”方面受到限制。(三)在明确了境外电影作品的版权认可方式上提出了境外电影作品的民事救济方式。(四)结合上述分析提出了《著作权法》第4条再修改的意见。从而得出一个较为完整的审查制度下境外电影作品的版权保护模式。

After the reform and opening-up, our country's economic level has been greatly improved, the internationalization is gradually strengthened, and people's demand for spiritual and cultural life after meeting the material demand is also higher and higher, so more and more foreign film works have entered the domestic market. However, due to the existence of the review system, foreign film works always encounter a layer-by-level limitation in the process of entering the market of our country. Therefore, in the era of high-speed development of science and technology, many foreign film works have entered China through the Internet and so on, so as to escape the link of the film review, thus causing a lot of foreign film copyright infringement. However, the 鈥淭he production and dissemination of works prohibited by law shall not be protected by this Law鈥
