儒学传统文化的知识产权保护研究

【摘要】：随着全球经济的快速发展,各国之间的综合国力竞争日益激烈,而这种竞争不再仅仅局限于经济上,文化也愈来愈成为民族团结和创新的重要源泉,愈来愈成为各国综合国力竞争的关键性因素之一。传统文化作为文化的重要组成部分,是一定的群体或民族在自己长期的生活生产实践中所创造出来,并由世代传承发展和文明演化而汇集成的智力性创造成果。传统文化反映的是一定的群体或民族的品质和特色,它是一个国家宝贵的文化遗产,对一个国家的发展产生着深远的影响。中华民族宝贵的传统文化是中华民族生命之重要组成部分,也是中华民族屹立于世界民族之林的基石,而在我国传统文化中最具有代表性的则是儒学传统文化,儒学传统文化是中华民族传统文化的精髓和核心,它的思想理论中包含有很多重要的价值理念和道德准则,而这些宝贵的价值理念和道德准则是我们现代人所需要学习的。另外,儒学传统文化是中华民族几千年来的文化成果,是中华民族智慧的结晶,它蕴含着丰富的经济价值、政治价值、文化价值和社会价值。儒学传统文化重要的文化地位和巨大的价值决定了我们有必要对其进行一定的法律保护,由于儒学传统文化自身的属性比较符合知识产权法保护的对象,所以本文主要从知识产权的角度讨论儒学传统文化的法律保护问题。 本文首先通过分析儒学传统文化的核心文化地位、表现形式、价值等得出对儒学传统文化进行知识产权保护的必要性,然后结合儒学文化的特征论述了儒学传统文化知识产权保护的可行性。由于儒学传统文化不同于一般的知识产权保护对象,它具有诸如创作者群体性、传承性、创作长期性、层次性、作者不确定性等独特属性。本文一开始分析运用现行的非物质文化遗产保护模式和著作权保护模式对其进行保护,但发现这两种保护模式在对儒学传统文化进行保护时都存在一定的漏洞和缺陷,因此,得出结合儒学文化自身的独特属性制定儒学传统文化知识产权特别法法律体系的构想。 最后,本文结合上述的分析论证对儒学传统文化知识产权特别法法律体系的构建提出了一些自己的建议。在分析构建适用于保护儒学传统文化的特殊法律制度的内容时,通过对比分析各种保护模式优劣,结合儒学文化自身独特属性,并参照现行的知识产权法得出了一些不太成熟的观点,文章最后主要从保护范围、权利主体、权利内容、保护期限以及侵权行为和救济措施等几个方面来论证这些观点。最终,希望通过运用知识产权特别法实现对儒学传统文化的全面保护,保护其免遭不必要的歪曲和篡改,使其在充分发挥自己的价值的同时,可以得到更好的传播和发展。
[Abstract]:With the rapid development of the global economy, the competition of comprehensive national strength among countries is becoming increasingly fierce, and this competition is no longer confined to the economy only, and culture is becoming an important source of national unity and innovation. Increasingly, it has become one of the key factors in the competition of comprehensive national strength. As an important part of culture, traditional culture is a kind of intellectual creation which is created by certain groups or nations in their own long-term life and production practice, and accumulated by generations of inheritance, development and evolution of civilization. Traditional culture reflects the quality and characteristics of a certain group or nation. It is a valuable cultural heritage of a country and has a profound influence on the development of a country. The precious traditional culture of the Chinese nation is not only an important part of the life of the Chinese nation, but also the cornerstone of the Chinese nation standing among the nations of the world, while the traditional culture of Confucianism is the most representative in the traditional culture of our country. Confucian traditional culture is the essence and core of Chinese traditional culture, and its theory contains many important values and moral norms, and these valuable values and moral norms are what modern people need to learn. In addition, the traditional culture of Confucianism is the cultural achievement of the Chinese nation for thousands of years and the crystallization of the wisdom of the Chinese nation. It contains rich economic value, political value, cultural value and social value. The important cultural status and great value of the traditional culture of Confucianism make it necessary for us to protect it by law, because the attribute of the traditional culture of Confucianism accords with the object of intellectual property protection. Therefore, this paper mainly discusses the legal protection of Confucian traditional culture from the angle of intellectual property. Firstly, through analyzing the core cultural status, manifestation and value of the traditional culture of Confucianism, this paper concludes the necessity of intellectual property protection of the traditional culture of Confucianism. Then it discusses the feasibility of intellectual property protection of Confucian traditional culture combined with the characteristics of Confucian culture. Because the traditional culture of Confucianism is different from the general object of intellectual property protection, it has such unique attributes as group, inheritance, long-term creation, hierarchy and uncertainty of the author. At the beginning of this paper, we use the existing intangible cultural heritage protection mode and copyright protection mode to protect them. However, we find that both of them have some loopholes and defects in the protection of traditional Confucian culture. The special law system of intellectual property rights of traditional culture of Confucianism is proposed by combining the unique attributes of Confucian culture itself. Finally, this paper puts forward some suggestions on the construction of the special law system of intellectual property rights of Confucian traditional culture combined with the above analysis and argumentation. When analyzing the content of the special legal system suitable for protecting the traditional culture of Confucianism, by comparing and analyzing the merits and demerits of various protective modes, combining with the unique attribute of Confucianism culture itself, At the end of this paper, the author demonstrates these views from the aspects of the scope of protection, the subject of rights, the content of rights, the duration of protection, the tort and relief measures, etc. Finally, it is hoped that the traditional culture of Confucianism can be fully protected by the special law of intellectual property rights, and that it can be better spread and developed while giving full play to its own value, so as to protect it from unnecessary distortion and tampering.
