知识产权交易中介机构定位的法律问题研究

【摘要】：随着现代高新知识产业的发展和信息时代的来临，知识产权已成为权衡一个企业生命力及竞争力的重要标志。我国知识产权交易市场运行多年来创造了巨大的经济价值，知识产权交易体系建设迅速，成效明显。然而，由于世界知识经济的兴起，以及国家经济刺激方案的出台，国民生产总值增长速度的迅速下降使制造业的危机日益凸显。特别是在由美国次贷危机引发的全球金融危机正在向实体经济迅速扩展的背景下，，世界各国都在启动新一轮大规模的知识产权交易投资，世界级的知识产权交易体系建设发展迅速。国内的理论界和实践界对中国知识产权交易中介机构定位涉及的一系列法律问题的研究需求也日益迫切。本文以此为背景，从法律层面就如何推进我国知识产权交易中介机构健康发展进行了研究。首先，本文从知识产权交易中介机构的概念和类别入手，分析了知识产权交易中介机构发展的现状和存在的问题。其次，文章针对我国知识产权中介市场存在的法律制度尚不健全，服务层次较低，条块分割现象严重，从业人员数量不足、素质较低、资金来源少，组织管理体制尚待健全，市场开放程度低等现象从法律的角度对知识产权交易中介机构的法律性质进行再分析。在明确了知识产权交易中介机构的功能定位之后文章对知识产权交易中介机构的发展前景做了有益的探讨。文章指出要实现知识产权交易中介机构业务的综合化、标准的统一化、规范的法制化、服务形式的电子化这一发展的大趋势，除了知识产权交易中介机构本身要加快产业的转型升级外，政府应当积极优化对知识产权交易中介行业的宏观调控，知识产权交易中介行业协会也应当加强自律管理。最后，文章在知识产权交易中介法律制度建设方面，就如何健全知识产权交易法律制度、完善知识产权交易法治体系、降低知识产权交易政策法律风险等问题进行了有益的思考。笔者相信，只有多方共同努力，才能推动知识产权交易市场的持续健康发展，实现知识产权强国的中国梦。
[Abstract]:With the development of modern high-tech knowledge industry and the advent of the information age, intellectual property has become an important symbol to weigh the vitality and competitiveness of an enterprise. Over the years, China's intellectual property trading market has created great economic value, and the intellectual property trading system has been built rapidly and has achieved remarkable results. However, due to the rise of the world's knowledge economy and the introduction of the national economic stimulus plan, the rapid decline in the growth rate of the gross national product (GNP) makes the crisis in the manufacturing industry increasingly prominent. Especially against the background that the global financial crisis caused by the US subprime mortgage crisis is rapidly expanding into the real economy, countries around the world are launching a new round of large-scale investment in intellectual property transactions. The construction of the world-class intellectual property trading system has developed rapidly. The domestic theoretical and practical circles are increasingly demanding to study a series of legal issues involved in the positioning of China's intellectual property transaction intermediaries. Based on this background, this paper studies how to promote the healthy development of China's intellectual property transaction intermediaries from the legal level. First of all, this paper starts with the concept and category of intellectual property transaction intermediary, and analyzes the present situation and existing problems of the development of intellectual property transaction intermediary. Secondly, the legal system of intellectual property intermediary market in China is not perfect, the level of service is low, the phenomenon of fragmentation is serious, the number of employees is insufficient, the quality is low, the source of funds is few, and the system of organization and management is still to be perfected. The low degree of market opening reanalyzes the legal nature of intellectual property transaction intermediaries from the legal point of view. After defining the function orientation of the intellectual property transaction intermediary, this paper makes a beneficial discussion on the development prospect of the intellectual property right transaction intermediary. The article points out that it is necessary to realize the development trend of the integration, the unification of the standards, the legalization of the norms and the electronization of the form of service, which are the main trends of the business of the intermediary agencies of intellectual property transactions. In addition to speeding up the transformation and upgrading of the industry, the government should actively optimize the macro-control of the intellectual property transaction intermediary industry, and the intellectual property transaction intermediary trade association should also strengthen the self-regulation and management. Finally, the article in the intellectual property transaction intermediary legal system construction, on how to improve the intellectual property transaction legal system, improve the intellectual property transaction rule of law system, Reduce the intellectual property rights transaction policy legal risk and other issues to carry on the beneficial consideration. I believe that only by working together, can we promote the sustainable and healthy development of the intellectual property trading market, and realize the intellectual property power Chinese Dream.
