后危机时代知识产权贸易壁垒对我国出口企业的影响及应对

【摘要】：后金融危机时代，伴随着知识经济时代的到来，国与国之间科学技术的传播越来越多，，国际贸易保护措施正经历着新的变革，与贸易有关的知识产权越来越受到重视，知识产权贸易壁垒逐步成为发达国家实施贸易保护的重要手段。国际贸易中因知识产权纠纷引发的贸易摩擦越来越多，如何充分保护自身的知识产权以及防御外部知识产权的威胁成为每个国家和地区面临的重要任务。对我国而言，知识产权贸易壁垒已成为影响我国产品出口的重要因素，对我国出口企业的出口贸易影响深远。本文共分为七大部分。第一部分提出本文的研究背景和研究意义，并对国内外对知识产权贸易壁垒相关研究做一个简单综述，在此基础上提出本文的研究方法、研究思路以及本研究的创新之处。第二部分主要介绍知识产权贸易壁垒的含义、特点与表现形式，重点分析后危机时代知识产权贸易壁垒的新特点、新形式。第三部分阐述知识产权壁垒的相关的贸易理论，从理论上论述知识产权贸易壁垒对出口贸易数量的抑制效应，最后论述一般均衡条件下实施知识产权壁垒的经济效应。第四部分从出口企业与出口贸易两个层面分析我国出口企业遭受知识产权贸易壁垒的内在和外在原因。第五部分从我国出口企业的微观和宏观层面分别分析知识产权贸易壁垒短期内和长期内所带来的影响。本文的第六部分是实证分析部分，通过对我国遭受美国337条款调查的主要特点、涉及行业、调查变化趋势的分析，以高新技术产业和光伏产业两个产业层面为例，实例分析知识产权贸易壁垒对我国出口企业的实际影响。第七部分后危机时代我国出口企业应对知识产权壁垒的策略是全文的结尾部分，在以上分析的基础上针对我国目前出口企业的实际情况提出出口企业应对知识产权贸易壁垒的策略，为出口企业提供一定的指导。
[Abstract]:In the post-financial crisis era, with the advent of the era of knowledge economy, the spread of science and technology between countries is increasing, international trade protection measures are undergoing new changes, trade-related intellectual property rights are being paid more and more attention. Trade barriers to intellectual property rights have gradually become an important means of implementing trade protection in developed countries. There are more and more trade frictions caused by intellectual property rights disputes in international trade. How to fully protect their own intellectual property rights and defend against the threat of external intellectual property rights has become an important task for every country and region. For our country, the intellectual property right trade barrier has become the important factor that affects our country's product export, and has far-reaching influence on the export trade of our country's export enterprises. This article is divided into seven parts. The first part puts forward the research background and significance of this paper, and makes a brief review of the related research on intellectual property barriers at home and abroad. On this basis, it puts forward the research methods, research ideas and the innovation of this study. The second part mainly introduces the meaning, characteristics and forms of intellectual property barriers, focusing on the new features and new forms of intellectual property barriers in the post-crisis era. The third part expounds the related trade theory of intellectual property barriers, discusses theoretically the inhibitory effect of intellectual property barriers on the quantity of export trade, and finally discusses the economic effects of implementing intellectual property barriers under general equilibrium conditions. The fourth part analyzes the internal and external reasons why China's export enterprises suffer intellectual property barriers from two aspects: export enterprises and export trade. The fifth part analyzes the short-term and long-term impact of intellectual property barriers from the micro-and macro-level of China's export enterprises. The sixth part of this paper is the empirical analysis part. Through the analysis of the main characteristics of the US Section 337 investigation, involving the industry, the trend of investigation and change, taking the high-tech industry and photovoltaic industry as an example, An example is given to analyze the actual impact of intellectual property barriers on China's export enterprises. The seventh part is the end of the thesis, which is the strategy of China's export enterprises to deal with intellectual property barriers in the post-crisis era. On the basis of the above analysis, according to the actual situation of export enterprises in our country, this paper puts forward the strategies of export enterprises to deal with the trade barriers of intellectual property rights, and provides some guidance for export enterprises.
