低碳技术转移与知识产权保护冲突研究

【摘要】:气化变化引发的危机已经严重影响到人类的生存和发展,低碳技术的使用是应对这一危机的最主要手段。发达国家经过两百多年的工业化发展,积累了相当量的财富和技术,利用最先进的低碳技术控制了本国二氧化碳的排放量,而发展中国家在其工业化过程中,由于缺乏资金和技术,仍然处于粗放式生产阶段,排放了大量的二氧化碳。但是空气是流动的,气候变化引发的灾难没有哪一个国家能够幸免。在此背景之下,低碳技术从发达国家向发展中国家转移是大势所趋。但是目前低碳技术的转移现状并不令人满意。影响低碳技术转移的因素有很多,高额关税、投资风险、高利润比等等,而知识产权保护制度则一直是是发达国家和发展中国家争论的焦点。双方均认为知识产权制度阻碍了低碳技术的转移,只是发达国家认为发展中国家知识产权制度不够完善,导致企业不愿意进行技术转移;发展中国家则认为是世界范围内知识产权保护急剧扩张导致大型企业享有绝对的垄断优势,使发展中国家企业无法在市场机制下获得低碳技术。因此,我们需要探究的是低碳技术与知识产权保护之间的关系究竟如何、产生“阻碍”的本质原因是什么、现有的解决这种冲突的理论和机制不能有效发挥作用的原因是什么。本文主要采用理论分析的方法,将全文分为六个部分对问题进行阐述、分析。第一章简要介绍本文的研究背景与意义、研究现状和研究内容与方法。第二章对低碳技术的特点和转移模式进行介绍,重点阐述低碳技术转移的必要性。第三章探究低碳技术转移与知识产权保护之间的关系,产生冲突的本质原因,并对冲突的表现进行了介绍。第四章主要介绍为了解决低碳技术转移与知识产权保护的冲突、促进技术转移,所引入的理论建议和国际公约规定的机制。第五章解决低碳技术转移与知识产权保护冲突的基本原则和具体措施建议。第六章对全文进行总结。
[Abstract]:The crisis caused by gasification has seriously affected the survival and development of human beings. The use of low-carbon technology is the most important means to deal with this crisis. After more than 200 years of industrial development, developed countries have accumulated equivalent wealth and technology, using state-of-the-art low-carbon technologies to control their carbon dioxide emissions, while developing countries in the course of their industrialization, Due to lack of funds and technology, it is still in the extensive production stage, emitting a large amount of carbon dioxide. But the air is flowing, and no country can survive the disaster caused by climate change. In this context, the transfer of low-carbon technology from developed countries to developing countries is the general trend. But the current low-carbon technology transfer status is not satisfactory. There are many factors affecting the transfer of low-carbon technology, such as high tariffs, investment risk, high profit ratio, and so on. The intellectual property protection system has always been the focus of debate between developed and developing countries. Both sides believe that the intellectual property system hinders the transfer of low-carbon technology, but the developed countries believe that the intellectual property system in developing countries is not perfect, which leads to the reluctance of enterprises to transfer technology; Developing countries believe that the rapid expansion of intellectual property protection in the world has led to the absolute monopoly advantage of large enterprises, which makes developing countries unable to obtain low-carbon technology under the market mechanism. Therefore, what we need to explore is how the relationship between low-carbon technology and intellectual property protection is, what is the essential cause of "hindrance", and what is the reason why the existing theories and mechanisms to resolve this kind of conflict cannot play an effective role. This article mainly uses the theoretical analysis method, divides the full text into six parts to carry on the elaboration and the analysis to the question. The first chapter briefly introduces the research background and significance, research status, research contents and methods. The second chapter introduces the characteristics and transfer mode of low-carbon technology, focusing on the necessity of low-carbon technology transfer. The third chapter explores the relationship between low-carbon technology transfer and intellectual property protection, the essential cause of conflict, and introduces the performance of conflict. The fourth chapter mainly introduces the theoretical suggestions and mechanisms stipulated in international conventions in order to solve the conflict between low-carbon technology transfer and intellectual property protection and to promote technology transfer. Chapter five: the basic principles and specific measures to solve the conflict between low-carbon technology transfer and intellectual property protection. The sixth chapter summarizes the full text.
