技术标准化视野中的专利池相关法律问题研究

【摘要】：知识经济时代,尤其是在全球经济一体化的大背景下,技术标准与知识产权战略日益成为全球关注的热点话题。加入WTO伊始,我国便遭遇DVD专利收费事件,此后一系列实践案例和全球热点技术标准之争开始引发我们对标准与知识产权的相互结合的思考。中国企业开始逐渐从教训中感悟技术标准与知识产权战略的重要性,在标准制定方面开始紧跟世界技术发展的前沿,出现了如EVD、闪联(][GRS)、TD-SCDMA、 WAPI等一批先进标准,但我国企业缺乏对国际标准规则的运用能力,同等技术却享受不同等的标准待遇。如何提高中国企业对国际规则的运用能力成为目前最为迫切予以关注的课题。 本论文选取技术标准与专利权结合后对中国企业参与国际标准化进程阻碍最大的专利池为研究对象,因为现今在技术标准的标准制定组织、专利权人和标准使用者三方利益博弈中,我国多数处于标准使用者的地位,参与权和话语权力量不足,从而也将技术标准组织对外进行打包、一揽子许可的专利池推向风口浪尖,对专利池的认识和运用停留在联合限制竞争、垄断、阻碍创新等消极方面。本论文就是在探究标准化专利政策的同时,通过大量数据和案例,借鉴国外及国际主流技术标准与专利池的管理经验,正反两方面对比分析技术标准化下专利池的特征、作用和法律规制,全面梳理技术标准化下专利池的理论及实践,努力为我国技术标准与专利池的构建提供全面分析,总结存在的问题,提供解决问题的思路及根本途径,全面提高对技术标准和专利池的运用水平,真正体会技术标准化下专利池“既是藩篱,更是利剑”的深刻内涵。
[Abstract]:In the era of knowledge-based economy, especially in the background of global economic integration, technical standards and intellectual property strategy have increasingly become a hot topic of global concern. At the beginning of China's entry into WTO, China has encountered DVD patent charges. After that, a series of practical cases and the dispute over global hot technology standards have led us to think about the combination of standards and intellectual property rights. Chinese enterprises began to realize the importance of technology standard and intellectual property strategy from the lessons, and began to follow the frontier of world technology development in the aspect of standard-making, such as EVD, flash link (GRS), TD-SCDMA,). WAPI and other advanced standards, but China's enterprises lack the ability to use international standard rules, the same technology is not the same as the standard treatment. How to improve the ability of Chinese enterprises to use international rules has become the most urgent issue. This paper selects the patent pool which is the biggest hindrance to Chinese enterprises' participation in the international standardization process after the combination of technical standards and patent rights, because of the current standard-setting organizations in technical standards. In the tripartite interest game between the patentee and the standard user, most of our country is in the position of the standard user, and the power of the participation right and the discourse right is insufficient, thus, the technical standard organization is also packaged to the outside world. The patent pool with a package of licenses is pushed to the top of the storm, and the understanding and application of the pool remain in the negative aspects of joint restriction of competition, monopoly, and hindrance of innovation. This paper is to explore the patent policy of standardization, through a large number of data and cases, draw lessons from foreign and international mainstream technical standards and patent pool management experience, and analyze the characteristics of patent pool under technical standardization in both positive and negative aspects. The function and the legal regulation, combs the patent pool theory and the practice under the technical standardization comprehensively, strives to provide the comprehensive analysis for our country technical standard and the patent pool construction, summarizes the existing problem, provides the thought and the fundamental way to solve the problem. In order to improve the application level of technical standard and patent pool in an all-round way, we really realize the profound connotation of patent pool under technical standardization, which is not only a barrier, but also a sword.
