反垄断适用除外制度与科技创新关系研究

【摘要】：科学技术的创新与竞争已成为当今世界经济发展的重要组成部分,科技创新俨然已代表着国家科技水平的核心竞争力量。囿于我国科技创新起步较晚的现状,针对科技创新领域的世界格局,我国制定了“建设创新型国家”的科技发展目标。如何从法律制度上鼓励科技创新,规制那些以科技创新为名而实施的垄断行为,从而提高我国的科技创新实力是我们需要研究的重要问题。本文以反垄断适用除外制度鼓励科技创新的合理性分析为基础,通过对国内外科技创新领域反垄断除外制度的发展及现状进行剖析和对比,以一种新的角度为我国科技创新领域反垄断适用除外制度的完善提出一些建议。本文共分为四个部分：第一部分绪论,重点在于对研究背景,选题意义以及研究方法和创新点的介绍；第二部分以反垄断适用除外制度的价值追求分析为基础,并结合反垄断适用除外制度鼓励科技创新的途径对反垄断适用除外制度的合理性进行论述；第三部分通过对国内外科技领域滥用反垄断除外制度具体案例的分析,来探究那些以科技创新为名实施垄断行为的企业的动因,以便从根本上剖析出现此种滥用行为的原因；第四部分通过对域外发达国家的反垄断适用除外制度进行比较和分析为我国反垄断适用除外制度的完善提供借鉴,并针对完善办法提出几点具体的措施。
[Abstract]:The innovation and competition of science and technology has become an important part of the world economic development, and scientific and technological innovation has represented the core competitive force of the national science and technology level. Due to the late start of scientific and technological innovation in China, in view of the world pattern in the field of scientific and technological innovation, China has formulated the goal of "building an innovative country". How to encourage scientific and technological innovation from the legal system and regulate the monopoly behavior carried out in the name of scientific and technological innovation, so as to improve the strength of scientific and technological innovation in China, is an important issue that we need to study. Based on the analysis of the rationality of encouraging scientific and technological innovation by the anti-monopoly exclusion system, this paper analyzes and compares the development and present situation of the anti-monopoly exclusion system in the field of scientific and technological innovation at home and abroad. From a new point of view, this paper puts forward some suggestions for the perfection of anti-monopoly application exclusion system in the field of scientific and technological innovation in China. This paper is divided into four parts: the first part is the introduction, which focuses on the introduction of the research background, the significance of the topic, as well as the research methods and innovations; The second part is based on the analysis of the value pursuit of the exclusion system of anti-monopoly application, and discusses the rationality of the exclusion system of anti-monopoly application combined with the ways of encouraging scientific and technological innovation of the exclusion system of anti-monopoly application. The third part analyzes the specific cases of abuse of antitrust exclusion system in the field of science and technology at home and abroad, to explore the motivation of those enterprises that carry out monopoly behavior in the name of scientific and technological innovation, in order to fundamentally analyze the causes of such abuse. The fourth part provides reference for the improvement of antimonopoly application exclusion system in our country by comparing and analyzing the anti-monopoly application exclusion system in developed countries outside the country, and puts forward some concrete measures for the improvement of the anti-monopoly application exclusion system in our country.
