能源企业海外投资的法律风险及对策

【摘要】：正近年来,中国企业境外投资持续增长,特别是近几年将"一带一路"作为我国未来发展和对外开放的主要战略,"一带一路"沿线国家资源丰富、能源需求大,为我国能源企业提供了巨大的海外投资机会和海外市场,为能源企业转型升级提供了一个巨大的契机。但也必须注意,欧美市场成熟度很高,"一带一路"贯穿几十个国家,市场差异又很巨大;各个国家在文化、经济、法律、政治和监管体系上都有诸多不同,风险巨大。能源企业"走出去"过程中,因政治环境、法律环境、商务合同、安全审查、劳工、环境保护以及知识产权等方面的法律问题导致投资失败的现象时有发生,法
[Abstract]:In recent years, the overseas investment of Chinese enterprises has continued to grow. In particular, "Belt and Road" has been regarded as the main strategy for China's future development and opening to the outside world in recent years. The countries along the "Belt and Road" line are rich in resources and have a large energy demand. It has provided huge overseas investment opportunities and overseas markets for Chinese energy enterprises, and provided a great opportunity for the transformation and upgrading of energy enterprises. However, it must also be noted that the European and American markets are highly mature, and "Belt and Road" runs through dozens of countries. The market difference is also very huge; each country has many different cultural, economic, legal, political and regulatory systems, and the risks are enormous. In the process of "going out", energy enterprises, because of the political environment, the legal environment, the business contract, the safety review, Legal problems such as labor, environmental protection and intellectual property rights often lead to investment failures.
