外币债务判决中的兑换日规则

【摘要】：选择兑换日也就意味着选择汇率,这是外币债务判决中无法避免的问题。国际上先后出现过三种兑换日规则,即违约日规则、支付日规则和联邦规则。但任何一种单一兑换规则都存在其自身的缺陷或弊端,没有哪一个规则可以绝对地、强制性地适用于外币债务判决中。一种更加灵活的规则即"合理方法"应该得到各国法院的推崇和支持,根据该规则,法院只能通过对具体案件的分析,对当时国际汇率形势的观察,才能得出公平合理的解决办法。
[Abstract]:Choosing the exchange date means choosing the exchange rate, which is an unavoidable problem in the judgment of foreign currency debt. There have been three kinds of convertibility day rules in the world, namely, the date of breach of contract rule. The payment day rule and the federal rule. But any single convertibility rule has its own flaws or drawbacks, and no single rule can be absolutely, Mandatory application to foreign currency debt judgements... a more flexible rule, the "reasonable method", should be respected and supported by national courts, according to which the Court can only analyse specific cases, Only by observing the international exchange rate situation at that time can we arrive at a fair and reasonable solution.
