中国知识产权保护与FDI增长的关系研究

【摘要】:我国在1985年首次出台专利法案,结束了之前没有知识产权保护的局面,并于1992年和2000年对其经行实质性修改后,形成了一个逐步改革并不断完善的专利系统。这意味着在开放经济环境下,知识产权保护的强度对于外商直接投资的影响越来越大,甚至成为我国吸引FDI的一个重要力量。利用外商直接投资一直是我国经济发展的一个重要战略。知识产权保护程度将会在很大程度上制约外商投资的力度和水平。为了持续高效的吸引FDI,研究我国知识产权保护强度和FDI增长之间的关系,从而为知识产权政策提供理论指导具有很强的现实意义,并成为一个亟待解决的重要课题。 针对发展中国家,探索知识产权在吸引外商直接投资中产生作用的实证研究文章较少,尤其是研究像中国这样的具有相当模仿能力的大型发展中经济国家。本文首先从理论方面验证了知识产权保护强度和FDI的关系,然后在理论分析的基础上引入引力模型验证了知识产权保护强度与激增的中国外国直接投资的实证关系。我们在进行知识产权强度衡量时,探讨了国际上最常用IPR保护强度测定方法在中国使用的可行性和局限性,并根据诸多中国学者研究对其进行了修正。本文利用30个国家的面板数据,证实了在中国加强知识产权保护强度对FDI有着积极并且显著的影响。最后在前面分析的基础上,结合中国知识产权保护存在的具体问题,在宏观管理和微观实施上提出了有效的建议。 本文着眼于中国这样一个在国际上具有强大影响力的发展中经济体,在过去的二十年经济发展过程中中国知识产权制度经历了非常显著的变化。过去的学术研究大部分站在工业化母国(例如:美国)的角度去研究FDI资金流向多样化的东道国群体的过程,本文首先针对IPR保护强度对FDI增长的作用进行了理论分析和格兰杰因果关系探讨。在格兰杰因果关系检验基础上我们断定了IPR与FDI有单相的格兰杰因果关系,于是我们引入引力模型用容量为30个国家的面板数据,这些数据覆盖了更广的时间(1985-2009),我们同时对于IPR的测定方法进行了改进,对传统国际研究采用的GinartePark方法进行了修正,使得实证结果更为精确。 实证结果表明,加强知识产权保护对于中国在吸引外商直接投资上对中国有着积极和显著得影响。结果还表明,除了知识产权,市场规模的大小区域一体化、运输和交易成本在中国对于FDI也是很重要的决定因素。此外,这个结果对于任何一个模型和数据样本的分割都有较强的稳健性。例如,无论是采用怎样的IPR政策,无论FDI源于发达还是发展中国家,IPR对于FDI的正面影响都具有十分显著的效果。总的来说,我们的结果表明,加强在发展中国家知识产权,特别是发展中大型经济体,可以起到促进吸引外商直接投资的积极作用,从而引发技术转移。
[Abstract]:Our country first issued the patent bill in 1985, which ended the situation that there was no intellectual property right protection before, and after it was substantially revised in 1992 and 2000, a patent system was gradually reformed and perfected. This means that under the open economic environment, the intensity of intellectual property protection has more and more influence on foreign direct investment, and even becomes an important force to attract FDI in China. The utilization of foreign direct investment has been an important strategy for China's economic development. The degree of intellectual property protection will greatly restrict the intensity and level of foreign investment. In order to attract FDI continuously and efficiently, it is of great practical significance to study the relationship between the intensity of intellectual property protection and the growth of FDI in China, thus providing theoretical guidance for intellectual property policy is of great practical significance, and has become an important subject to be solved urgently. For developing countries, there are few empirical studies on the role of intellectual property in attracting foreign direct investment, especially in large developing economies such as China. In this paper, the relationship between intellectual property protection intensity and FDI is theoretically verified, and then the gravitational model is introduced to verify the empirical relationship between intellectual property protection intensity and the surge of Chinese foreign direct investment (FDI) on the basis of theoretical analysis. When we measure the intensity of intellectual property, we discuss the feasibility and limitation of the most commonly used IPR protection strength measurement method in China, and revise it according to many Chinese scholars' research. Using panel data from 30 countries, this paper proves that strengthening the intensity of intellectual property protection in China has a positive and significant impact on FDI. Finally, on the basis of the previous analysis, combined with the specific problems of intellectual property protection in China, the author puts forward some effective suggestions on macro management and micro implementation. This paper focuses on China, a developing economy with great influence in the world. During the past two decades, China's intellectual property system has undergone very significant changes. Most past academic research has looked at the flow of FDI funds to diverse host populations from the perspective of industrialized home countries (e.g., the United States). In this paper, the effect of IPR protection intensity on FDI growth is analyzed theoretically and Granger causality is discussed. On the basis of Granger causality test, we conclude that IPR has a single-phase Granger causality with FDI, so we introduce gravitational model with panel data of 30 countries. These data cover a wider period of time from 1985 to 2009. We have also improved the method of IPR measurement and modified the GinartePark method used in traditional international research to make the empirical results more accurate. The empirical results show that strengthening the protection of intellectual property rights has a positive and significant impact on China in attracting foreign direct investment (FDI). The results also show that in addition to intellectual property rights, market size and regional integration, transport and transaction costs are also important determinants of FDI in China. In addition, this result is robust to any model and data sample segmentation. For example, no matter what kind of IPR policy is adopted, the positive effect of FDI from developed and developing countries on FDI is very significant. Overall, our results show that strengthening intellectual property rights in developing countries, especially in large developing economies, can play a positive role in attracting FDI and thus trigger technology transfer.
