后危机时代中国金融监管制度改革思考

【摘要】:在全球经济一体化的推动下,国际全融业处于新的改革浪潮中,这使金融监管面临更严峻的挑战。自2007年起,美国的次级债在全世界范围内所引发的金融危机,无疑对各个国家的金融监管体系都是一次极大的冲击。国际社会从加强国际金融监管合作,加强金融衍生工具监管等角度,做出了深入的探索以及反思,并获得了新的突破和进展。金融危机给我国造成的影响延续至今,怎样对国际先进成功的经验及成果进行借鉴,实现国内金融监管体制的改革及完善,保证我国金融安全性稳定运行,以国际金融监管发展趋势、方向及原则为参照,实现我国的经济和金融在世界经济一体化中占有一席之地,这也是目前我国金融业亟需解决的问题。 金融监管是指金融主管机关依据国家法律规定对整个金融业实施的监督管理,,目的是防范金融风险,维护金融体系的稳健运行。金融监管以公共利益理论、保护债权论、金融风险控制论为主要理论基础。本次全球性金融危机爆发后,暴露出了金融监管在宏观审慎性监管、逆周期监管、信用评级监管、影子银行监管以及金融消费者利益保护等问题和缺陷。各国针对这些问题和缺陷进行了深刻反思相应改革。其中,美国颁布了《美国金融监管改革计划》等法案,以法律手段确立了改革方式;英国的监管改革除了颁布了一系列的法案条例外,建立了新的监管框架,强调了系统性风险的监管;欧盟的改革是成立了欧盟系统风险委员会、建立欧盟金融监管系统等,致力于协调各成员国监管主体之间的合作;日本的监管改革包括颁布金融监管改革方案、增加保险监管内容等。中国金融业在本次危机中虽然未受到严重波及,但金融监管存在的问题逐渐显现,其中包括金融监管法律不健全、宏观审慎性框架不完善、监管协调机制缺陷等。借鉴发达国家金融监管改革的经验和启示,针对中国金融监管暴露的问题,在后危机时代,应从更新金融监管理念、完善金融监管体系与机制建设、建立具有特色金融消费者保护机制、妥善处理金融创新与监管的关系、加强国际间的金融监管合作等方面对中国金融监管制度进行改革与完善。
[Abstract]:With the promotion of global economic integration, the international financial industry is in a new wave of reform, which makes financial supervision face more serious challenges. Since 2007, the financial crisis caused by the United States subprime debt in the world is undoubtedly a great impact on the financial regulatory system of every country. From the angles of strengthening international financial supervision and cooperation and strengthening the supervision of financial derivatives, the international community has made a deep exploration and introspection, and has made new breakthroughs and progress. The impact of the financial crisis on our country continues up to now. How to draw lessons from the international advanced and successful experience and achievements, to realize the reform and perfection of domestic financial supervision system, and to ensure the stable operation of financial security in our country. According to the development trend, direction and principle of international financial supervision, China's economy and finance have a place in the world economic integration, which is also the problem that our financial industry needs to solve. Financial supervision refers to the supervision and management of the whole financial industry carried out by the competent financial authorities according to the national laws. The purpose is to guard against financial risks and to maintain the steady operation of the financial system. Financial supervision is based on the theory of public interest, the theory of protecting creditor's rights and the theory of financial risk control. After the global financial crisis broke out, it exposed the problems and defects of financial supervision in macro-prudential supervision, counter-cyclical supervision, credit rating supervision, shadow banking supervision and the protection of the interests of financial consumers. Various countries have carried on profound reflection on the corresponding reform in view of these problems and shortcomings. Among them, the United States promulgated "the United States Financial Supervision Reform Plan" and other bills, legal means to establish the way of reform; In addition to a series of regulations, the British regulatory reform has established a new regulatory framework, emphasizing the regulation of systemic risk; The reform of the European Union is the establishment of the European Union systemic risk Committee, the establishment of the European Union financial regulatory system and so on, committed to coordinate the cooperation between the various member States. Japan's regulatory reform includes the promulgation of financial regulatory reform plan, the addition of insurance regulatory content. Although China's financial industry has not been seriously affected in this crisis, the existing problems of financial supervision have gradually appeared, including imperfect financial supervision laws, imperfect macro-prudential framework, and defects of regulatory coordination mechanism. Drawing lessons from the experience and enlightenment of the financial supervision reform in developed countries, aiming at the problems exposed to the financial supervision in China, in the post-crisis era, we should renew the concept of financial supervision and perfect the financial supervision system and mechanism construction. To establish a special financial consumer protection mechanism, properly handle the relationship between financial innovation and supervision, and strengthen international financial regulatory cooperation to reform and improve China's financial regulatory system.
