无锡市餐饮服务食品安全监管问题研究

【摘要】:食品安全是当今社会普遍关注的焦点问题,餐饮服务作为食品供应链的终末端,与消费者是最直接接触的,它的安全与否至关重要。一个地区餐饮服务食品安全水平直接体现了该城市的经济发展水平、消费者的食品安全意识以及政府的治理能力。近年来,无锡市也不断发生"假牛肉"、"一滴香"、地沟油、火锅底料违规添加等食品安全问题,政府通过深化机构改革、完善监管机制、加大执法力度等措施,加强食品安全管理,基本稳定了食品安全大环境。但是随着生活水平提高和工作节奏加快,餐饮服务发展迅猛,导致餐饮服务企业诚信意识不强、食品安全管理能力差、监管部门执法力量薄弱、执法技术支撑滞后、消费者维权能力不足等,餐饮服务食品安全过渡依赖行政监管,食品安全社会共治的格局尚未形成。上述问题普遍存在于江苏各地区,本文依据无缝管理理论、信息不对称理论和政府失灵理论,运用数据采集法、文献研究法、比较研究法等,来研究餐饮服务食品安全监管中存在的问题。首先,明确餐饮服务、食品安全、行政监管的定义,对无锡市餐饮服务食品安全现状进行分析,探讨餐饮服务食品安全监管存在的问题;其次,对国外先进食品安全管理经验进行分析、借鉴;最后结合无锡市的具体情况以及自己在餐饮监管工作中的经验,提出了在餐饮服务监管过程中必须积极整合执法资源、构建执法三级网络、完善餐饮服务食品安全预警机制,通过构建行业信用、食品追溯、社会共治三大管理体系,促进餐饮服务行业健康良性发展。本文在理论方面,为我国完善法律规范提供了建议,积极推动了我国食品安全监管的理论研究;在实践方面,为无锡市餐饮服务环节监管工作、推动社会经济又好又快发展、保障人民群众健康提供了参考依据。
[Abstract]:Food safety is the focus of our society. As the end of food supply chain, food service is the most direct contact with consumers. The level of food safety in a region directly reflects the level of economic development of the city, the food safety consciousness of consumers and the governance ability of the government in recent years. In Wuxi City, food safety problems such as "fake beef", "a drop of incense", gutter oil and the illegal addition of hot pot bottom materials have been constantly occurring. The government has strengthened food safety management through deepening institutional reform, perfecting the supervision mechanism, and strengthening law enforcement measures. The food safety environment has basically been stabilized. However, with the improvement of living standards and the quickening pace of work, catering services have developed rapidly, leading to a weak sense of good faith, poor food safety management ability and weak law enforcement power of the regulatory authorities. Law enforcement technical support lags behind, consumer rights protection ability is insufficient, catering service food safety transition depends on administrative supervision, food safety social co-governance pattern has not yet formed. The above problems generally exist in all regions of Jiangsu. Based on seamless management theory, information asymmetry theory and government failure theory, this paper uses data collection method, literature research method and comparative research method to study the problems existing in food safety supervision of catering service. The definition of food safety, the definition of administrative supervision, the analysis of the present situation of food safety of catering service in Wuxi city, the discussion of the problems existing in food safety supervision of catering service, secondly, the analysis of the advanced food safety management experience of foreign countries. Finally, combined with the specific situation of Wuxi city and its own experience in the catering supervision work, the author puts forward that in the process of catering service supervision, we must actively integrate the law enforcement resources, construct a three-level law enforcement network, and improve the food safety early warning mechanism of catering service. In order to promote the healthy and healthy development of catering service industry, this paper provides suggestions for perfecting the legal norms of our country in theory, by constructing three management systems of industry credit, food tracing and social co-governance, and promoting the healthy and benign development of catering service industry. It actively promotes the theoretical research of food safety supervision in our country, and in practice, provides a reference basis for the supervision of catering service links in Wuxi City, the promotion of social economy and the rapid development of social economy, and the protection of the health of the people.
