比特币法律属性探析——从广义货币法的角度

【摘要】：比特币自诞生以来备受争议,金融监管部门和理论界往往以比特币潜在的金融风险和涉及比特币的互联网犯罪为理由否定其货币属性。然而,从当前货币法理论的发展和比特币的功能出发,比特币的货币属性应被肯定的,同时比特币引起的对现有法律制度和货币政策的冲击也可以得到妥善的解决。
[Abstract]:Bitcoin has been controversial since its birth. Financial regulators and theorists often deny its currency attributes on the grounds of its potential financial risks and Internet crimes involving Bitcoin. Based on the development of the current monetary law theory and the function of Bitcoin, the monetary property of Bitcoin should be affirmed, and the impact of Bitcoin on the existing legal system and monetary policy can also be properly solved.
