支付服务合规性视角下苹果微信支付争端评析

【摘要】：因苹果提出微信赞赏转走苹果支付渠道方案,苹果微信之间发生了微信赞赏支付渠道争端。苹果提出该方案意图在于借微信支付突破自身在中国市场支付业务的困境。从支付服务合规性角度考虑,该方案将违反中国第三方支付相关规则,这也是微信拒绝该方案的重要原因。在中国现有支付规则体系之下,未来苹果支付只有可能选择申请或不申请第三方支付牌照这两种突围策略。然而,无论何种策略都无助于苹果支付突围目标的实现。这或将促使苹果与微信重新回到谈判桌前,以协商方式解决争端。
[Abstract]:A dispute over the payment channel between WeChat and WeChat has arisen over Apple's proposal to transfer WeChat's appreciation to Apple's payment channel. Apple's proposal is intended to break through the plight of its payment business in China with WeChat Pay. From the point of view of payment service compliance, the scheme will violate Chinese third-party payment rules, which is also an important reason why WeChat rejected the scheme. Under China's current payment rules, Apple will only have to choose whether to apply for or not to apply for a third-party payment licence in the future. Neither strategy, however, will help Apple achieve its goal of breaking through. That could prompt Apple and WeChat to return to the negotiating table and settle the dispute through negotiation.
