工程量清单计价模式与固定总价合同的适用冲突研究

【摘要】：国内目前在工程造价领域存在两种主要的计价模式,即定额计价和工程量清单计价,其核心差别在于综合单价的组价。合同计价模式存在多种,主要的也有两种模式,即单价合同与总价合同,其核心差别在于基于工程总量和工程总价的风险范围划分。造价计价模式与合同计价模式本应无模式本身的风险冲突。然而,基于2013版工程量清单计价规范中,对于风险划分有如下约定“招标工程量清单必须作为招标文件的组成部分,其准确性和完整性应由招标人负责”,及对于合同价款有如下约定“实行工程量清单计价的工程,建议选择签订单价合同;对于那些工期不长,技术难度不高,整体规模不大,同时施工设计图已经通过审批的工程项目,可以选择签订总价合同”,以上约定事实上已产生工程量清单计价模式与总价计价模式的风险冲突。本文就工程量清单模式下采用总价合同计价的情况进行分析研究,拟明晰其量价风险划分的冲突,为工程量清单模式下采用总价合同计价的工程项目提供理论参考。工程实践中,我国采用工程量清单招标方式已经普及。本文针对总价合同下工程量清单量的完整性、程序性、补充计入问题,根据清单计价特点和固定总价合同特点,对总价合同下工程量偏差及清单缺漏项是否应该补充计入进行分析,并从法律效力角度出发,论证了清单计量原则、量的补充计入对总价合同的一些矛盾,根据这些矛盾提出一些相关建议,以求降低业主与承包商不可避免的一些风险,减少建筑市场存在的结算纠纷。
[Abstract]:At present, there are two main pricing modes in the field of project cost in China, that is, quota pricing and bill of quantities valuation. The core difference lies in the combined unit price. That is, the core difference between the unit price contract and the total price contract lies in the division of the risk range based on the total amount of the project and the total project price. There should be no risk conflict between the cost valuation model and the contract valuation model. Based on the specification for valuation of the bill of quantities of the 2013 edition of the project, there is the following agreement for the division of risks: "the bill of quantities for bidding works must be part of the tender documents," "the tenderer shall be responsible for the accuracy and completeness of the project, and the following agreement shall be made for the price of the contract". It is suggested that a unit price contract be signed for the works to be carried out in the form of bill of quantities; for those whose duration is not long, the technical difficulty is not high, and the overall scale is not high, At the same time, the construction design drawings have already passed the examination and approval of the engineering projects, Can choose to sign the total price contract ", the above agreement has actually produced the risk conflict between the bill of quantities valuation mode and the total price valuation mode. In order to clarify the conflict between the risk division of quantity and price, this paper provides a theoretical reference for the project with total price contract valuation in the mode of bill of quantities. In our country, the method of bill of quantities bidding has been popularized. This paper aims at the integrality, procedure and supplementation of bill of quantities under total price contract, according to the characteristics of list valuation and fixed total price contract. This paper analyzes whether the deviation of engineering quantity and the missing items of list should be added to the total price contract, and from the point of view of legal effect, demonstrates the principle of list measurement, the contradiction of the supplement of quantity to the total price contract, According to these contradictions, some relevant suggestions are put forward in order to reduce the inevitable risks between the employer and the contractor and to reduce the settlement disputes existing in the construction market.
