校园足球伤害事故治理研究

【摘要】：本文以校园足球伤害事故治理为研究对象,采用文献资料法、专家访谈法、逻辑分析法和系统分析法等研究方法,对校园足球伤害事故特点、成因、及治理现状进行研究,挖掘目前校园足球伤害事故治理过程中存在的困境,引入协同治理理论并结合我国国情,构建校园足球伤害事故协同治理体系,以期为高效合理处理校园足球伤害事故提供理论参考,减小校园足球发展过程中的阻力,促进校园足球活动健康发展与和谐校园建设,最终促进广大青少年身心健康、体魄强健、全面发展。本研究结论体现在以下四个方面:(1)校园足球伤害事故与学校体育伤害事故是个性与共性的关系,校园足球伤害事故是校园足球活动中体育伤害事故的具体化,当前校园足球伤害事故的处理可归纳为:处于治理初级阶段,单兵作战、效率低下是常态。(2)校园足球伤害事故的治理分为事故前的风险预防与事故后的处理。事故前的预防主要采用风险回避原则与风险控制原则。存在的困境主要表现为部分学校采用简单风险回避方式进行消极风险处理,以不踢球或减少踢球回避风险;风险控制力量单一,缺少多部门协作。事故发生后的处理困境主要表现在:协商、调解普遍使用但解决能力有限;仲裁、诉讼普遍存在但时间长、效率低下;归责原则适用时,公平责任原则适用中存在混乱与不公。校园足球事故发生后的赔偿困境主要体现在:资金短缺、赔偿能力有限;与事故赔偿相关的法律体系不完善;失真舆论的错误导向;保险机制不够完善,保险险种单一,覆盖面不广,民众的保险意识淡薄等。(3)当前校园足球伤害事故治理中的困境和需求正是协同治理理论存在的价值,表现出较好的契合性。协同治理理论为校园足球开展过程中的伤害事故治理提供理论支持、价值路径和实践指导,协同治理理论应用于校园足球伤害事故治理体系具有可行性。(4)基于协同治理模型构建了校园足球伤害事故治理体系,并从组织架构、模型元素、运行机制、外部环境等论证模型在“治理”中的“协同性”。
[Abstract]:This article takes the campus soccer injury accident management as the research object, uses the literature material method, the expert interview method, the logic analysis method and the system analysis method and so on research method, carries on the research to the campus soccer injury accident characteristic, the cause of formation, and the management present situation. This paper excavates the difficulties existing in the process of campus football injury accident management, introduces the theory of cooperative management and combines with the national conditions of our country, and constructs the cooperative management system of campus football injury accident. In order to provide a theoretical reference for the efficient and reasonable handling of campus football injury accidents, reduce the resistance in the development of campus football, promote the healthy development of campus football activities and the construction of harmonious campus, and finally promote the physical and mental health of the majority of young people. Strong physique and all-round development. The conclusion of this study is embodied in the following four aspects: 1) the relationship between campus football injury accident and school sports injury accident is the relationship between individuality and commonness, and campus football injury accident is the embodiment of sports injury accident in campus football activity. At present, the treatment of campus football injury accident can be summarized as: in the primary stage of management, fighting alone, low efficiency is the normal. 2) the management of campus football injury accident can be divided into pre-accident risk prevention and post-accident treatment. The principle of risk avoidance and risk control are mainly used in the prevention of accidents. The main predicaments are that some schools adopt simple risk avoidance to deal with negative risks in order not to play football or to reduce the risk of kickball avoidance; the risk control force is single and lack of multi-sector cooperation. The difficulties of dealing with the accident mainly lie in: negotiation, mediation is widely used but limited ability to resolve; arbitration, litigation is widespread but long time, low efficiency; when the principle of imputation applies, there is confusion and injustice in the application of fair liability principle. After the campus football accident, the compensation dilemma is mainly reflected in: shortage of funds, limited compensation capacity; imperfect legal system related to accident compensation; erroneous guidance of distorted public opinion; imperfect insurance mechanism, single type of insurance coverage. The difficulties and demands in the management of campus football injury accident are the value of the cooperative governance theory and show a good agreement. The theory of cooperative governance provides theoretical support, value path and practical guidance for the management of injury accidents in the course of campus football development. It is feasible to apply the cooperative governance theory to the campus soccer injury accident management system. (4) based on the cooperative governance model, the paper constructs the campus soccer injury accident management system, and from the organizational structure, model elements, operation mechanism, The external environment demonstrates the "synergy" of the model in "governance".
