美国职业篮球联盟2011年集体谈判合同研究

【摘要】:美国职业篮球联盟(National Basketball Association,以下简称“NBA”)作为全球极具影响力的职业体育联赛,它的成功得益于其成熟的联赛运营体制,其中最具盛名的便是集体谈判制度。这一制度使得劳资双方通过谈判签署集体谈判合同,对权利行使、人才流动、收益分配进行制衡。NBA集体谈判通常每六年举行一次,在前一个集体谈判合同到期后,双方会派出代表就有关利益的分配等问题再次进行谈判,签订一份新的集体谈判合同。正是通过这样定期的谈判从而维持了联盟和运动员工会之间的利益平衡,NBA联赛才能有序的发展前进。本文对2011年集体谈判合同文本进行了深入研究,首先介绍了2011年集体谈判合同的形成过程,并对合同的主要内容进行了重点分析,包括薪酬体系,运动员转会制度,运动员资格和NBA选秀,运动员行为和纪律,行程安排和仲裁体制。通过分析发现2011年集体谈判合同不仅制度健全规定详细,还有很多契合体育实际的特殊规定,合同中所体现的运营模式对NBA的平稳发展起到了至关重要的作用。最后还分析了我国职业篮球联赛中劳资关系的现状,发现我国的职业篮球联赛的运营模式存在很大漏洞,联赛内部的利益分配存在很大问题,导致俱乐部收益状况不佳,球员待遇得不到保障,如何在职业篮球联赛市场化进程中协调好劳资双方之间的关系,是推进我国职业篮球联赛快速和谐发展所要解决的重要问题,因此文章对完善我国职业篮球联赛的劳资关系提出了以下几点建议:1.完善我国职业篮球联赛的管理模式,坚持职业体育管理的三方机制原则,建立国际化的运动员工会,平衡篮球管理中心、俱乐部、运动员三者之间的关系,协调好俱乐部的运营内外环境,充分体现运动员的主体地位,改善国内运动员的竞技现状,充分保护运动员的根本权益。2.促进国内联赛收益分配的合理化,完善法律法规条例,协调好运动员与俱乐部的之间的利益分成,保障运动员的根本权益,形成良好的竞技激励机制,有效的提高我国职业篮球联赛的质量。3.完善我国职业篮球联赛争议处理机制,借鉴NBA集体谈判合同中的先进经验,结合我国的实际情况,通过调解、仲裁和司法诉讼的多元化方式来解决劳资纠纷。
[Abstract]:As one of the most influential professional sports leagues in the world, (National Basketball Association, (American Professional Basketball League) is successful thanks to its mature league operating system, among which the collective bargaining system is the most famous. This system allows employers and employees to negotiate collective bargaining contracts to counterbalance the exercise of rights, the flow of talent, and the distribution of proceeds. NBA collective bargaining usually takes place every six years, after the expiration of the previous collective bargaining contract. The two sides will send representatives to renegotiate on issues such as the distribution of interests and sign a new collective bargaining contract. It is through such regular negotiations to maintain a balance of interests between the league and the players' union that the NBA league can move forward in an orderly manner. This paper makes an in-depth study on the text of collective bargaining contract in 2011. Firstly, it introduces the forming process of collective bargaining contract in 2011, and analyzes the main contents of the contract, including salary system, athlete transfer system, and so on. Athlete qualification and NBA draft, athlete conduct and discipline, scheduling and arbitration system. Through the analysis, it is found that the collective bargaining contract in 2011 not only has a sound system and detailed regulations, but also many special provisions in line with the actual sports. The operation mode embodied in the contract has played a vital role in the smooth development of NBA. Finally, the paper analyzes the present situation of labor relations in professional basketball league in our country, and finds that there are many loopholes in the operating mode of professional basketball league in our country, and there are great problems in the distribution of interests within the league, which leads to the poor income situation of the club. The treatment of players can not be guaranteed, how to coordinate the relationship between employers and employees in the process of marketization of professional basketball league is an important problem to be solved in order to promote the rapid and harmonious development of professional basketball league in our country. Therefore, the article puts forward the following suggestions to improve the labor relations of our professional basketball league: 1. Perfecting the management mode of professional basketball league in our country, adhering to the principle of tripartite mechanism of professional sports management, establishing international trade union of athletes, balancing the relationship among basketball management center, club and athlete. To coordinate the internal and external environment of the club, fully reflect the main position of the athletes, improve the competitive status of domestic athletes, and fully protect the fundamental rights and interests of the athletes. 2. To promote the rationalization of income distribution in domestic league matches, to perfect laws and regulations, to coordinate the sharing of interests between athletes and clubs, to protect the fundamental rights and interests of athletes, and to form a good competitive incentive mechanism. Effectively improve the quality of China's professional basketball league. 3. Improve the dispute handling mechanism of professional basketball league in our country, learn from the advanced experience of NBA collective bargaining contract, combine with the actual situation of our country, solve the labor dispute through the diversified ways of mediation, arbitration and judicial litigation.
