民办幼儿园与地方教育行政机关关系的研究

【摘要】: 随着办学体制改革的深入,各类幼儿园不断涌现,幼儿教育的局面得到很大改 变,幼儿园数量增多,幼儿的入园率不断增加,幼教事业逐渐形成了以民办园为 主体、公办园为龙头的局面,但是由于我民办幼儿园尚缺乏足够的管理经验,导 致当前民办幼儿园存在诸多问题,,尤其是中小城市表现突出。考虑到教育行政机 关是我国教育执法最主要的主体,民办幼儿园与教育行政部门的关系在很大程度 上决定幼儿教育体制的性质与走向,因此建构中小缄市中民办幼儿园与教育行政 机关理想关系,在现实生活中寻找与之差距并提出相应对策,应是当前促进我国 幼儿教育事业规范发展的重要之举。 基于以上考虑,本论文在结构上分为五大部分: 绪论部分:根据当前教育体制改革的社会背景,提出民办幼儿园的出现有其必 然性和可行性,对民办幼儿园的研究具有重要的现实意义。本论文主要采取理论 和社会调查相结合的研究方法,从法律法规的角度探讨地方教育行政机关如何管 理民办幼儿园。 第一章阐述了中外民办幼儿园的发展历程。我国民办幼儿园的发展是以1949 年中国解放为分界岭,具体阐述了不同时期的中国民办幼儿园的发展,从而得出 结论:无论什么年代的民办幼儿园都离不开政府的支持和管理。对于国外的民办 幼儿园,本论文选择了日本、美国和法国三国作为研究的内容,最后总结出即使 国外的民办幼儿园也不例外地需要政府的支持和管理。从而为中小城市民办幼儿 园与地方教育行政机关关系的建构奠定基础。 第二章借鉴国外民办幼儿园与地方教育行政机关的关系,根据中小城市的特 点,阐述我国中小城市民办幼儿园与地方教育行政机关的理想关系,是以政策法 规为导向的宏观管理和以地方高校为基地的社会力量参与的关系。 第三章从法律法规的角度阐述现实生活中民办幼儿园和地方教育行政机构各 自的权利和义务。在这一部分里,本论文从应然和实然两个方面着手,具体阐述 了民办幼儿园和地方教育行政机关应然的权利和义务,民办幼儿园和地方教育行 政机关实然的权利和义务,研究发现应然和实然之间存在一定差距。通过分析得 出,以上四种权利和义务的错综交织归根结底实际上是权力与权利两者之间的关 系,其中权力在整个关系的建构中起着重要作用。 第四章着重阐述了地方教育行政机关管理民办幼儿园的难为,并相应提出了对 策以帮助建立二者之间的合理关系。地方教育行政机关权责难为主要表现在四个 方面:1、政策法规保障机制较弱 2、教育执行者自身素质欠缺 3、各行政部门沟 通不够 4、责任追究机制还未建全,为此,需要从以下几方面着手解决:1、增强教 育执行者依法治教的观念 2、制定地方性教育法规,加强各部门的联系 3、完善教 育执法监督,建立教育法律责任机制。 总之,本论文通过对民办幼儿园历史与现实的探讨,从理论层面入手,结合相 关法律法规,系统阐述了民办幼儿园与地方教育行政机关的关系。
[Abstract]:With the deepening of the reform of school running system, various kindergartens are constantly emerging, and the situation of early childhood education has been greatly changed.
The number of kindergartens has increased, and the rate of kindergarten attendance has been increasing.
The main body is the situation of public parks, but my private kindergartens do not have enough management experience.
There are many problems in the current private kindergartens, especially in small and medium-sized cities.
Guan is the main body of education law enforcement in China, and the relationship between private kindergartens and educational administration departments is very large.
It determines the nature and trend of the early childhood education system, and constructs private kindergartens and educational administration in small and medium-sized cities.
The ideal relationship between organs and the gap between them in real life and the corresponding countermeasures should be promoted at present.
An important approach to the development of preschool education.
Based on the above considerations, the thesis is divided into five parts in structure.
Introduction: according to the social background of the current educational system reform, it is pointed out that the emergence of private kindergartens must have their own needs.
Nature and feasibility have important practical significance to the research of private kindergartens.
How to manage the local educational administration from the perspective of laws and regulations
A private kindergarten.
The first chapter expounds the development process of private kindergartens at home and abroad. The development of private kindergartens in China is based on 1949

Conclusion: no matter what age private kindergartens are inseparable from the support and management of the government.

In this part, the thesis starts from two aspects: the ought to be and the reality.
The rights and obligations of private kindergartens and local educational administrative organs, private kindergartens and local educational institutions.
The actual rights and obligations of the political organs have found that there is a certain gap between the ought and the reality.
In the final analysis, the above four kinds of rights and obligations are actually intertwined between power and rights.
System, in which power plays an important role in the construction of the whole relationship.
The fourth chapter focuses on the difficulties of local educational administrative organs in managing private kindergartens, and puts forward corresponding suggestions.
In order to help to establish a reasonable relationship between the two, the local educational administrative organ's power and responsibility are mainly manifested in four aspects.
Aspects: 1, 2 are weak in policies and regulations, and 3 in educational administrators.
If there is not enough 4, the accountability mechanism has not yet been established. For this reason, we need to solve the following problems: 1, enhance teaching.
2, the concept of education by law enforcement practitioners according to law. The local education laws and regulations should be formulated, the links between departments should be strengthened 3, and teaching should be perfected.
The supervision of law enforcement and the establishment of the mechanism of legal responsibility for education are established.
In short, this paper discusses the history and reality of private kindergartens from the theoretical level.
The relationship between private kindergartens and local educational administrative organs is systematically expounded in accordance with laws and regulations.
