“微商”模式下消费者权益保护法律问题研究

【摘要】:近年来,由于智能手机的普及和移动社交软件用户数量的急剧增加,越来越多的人开始关注社交平台巨大的商业价值。随即产生出一种依赖于移动社交软件的新型电子商务,那就是微商。由于入门容易,操作简单,工作灵活自由,微商实现了爆发式地发展。然而,由于没有明确的法律规制也缺乏类似于传统网络购物的监管措施,加之经营者诚信意识淡薄导致微商的发展呈现出暴力刷屏、过度宣传、假货泛滥等乱象。消费者的正当权益遭到侵害且维权艰难日益影响着整个行业的健康发展。因而,微商模式下如何保护消费者合法权益是横亘在我们面前的一个亟待解决的问题。本文除引言和结语外,正文共三个部分。第一部分提出问题。鉴于微商是一种新型的购物模式,笔者首先对微商进行了界定,在此基础上,对微商购物与传统购物和网络购物进行了对比。其次,指出微商购物中消费者权益保护面临如下问题:微商侵权具有隐蔽性、微商模式下消费者求偿权难以实现、微商模式下消费者维权成本高。第二部分是分析问题。对微商购物中消费者权益被侵犯的原因进行了分析。首先,是立法上的原因。包括:对微商依赖的社交平台的责任没有规定;公益诉讼制度存在缺陷。其次,是工商监管执法的困境。包括:缺乏微商市场准入制度;没有针对微商的行之有效的监管措施。第三,社交平台缺乏对微商的监管。包括:没有实名认证和担保金,微商侵权代价极低;微商交易直接转账,财产安全难以保障;没有信用评价导致消费者无法对商家形成压力。第三部分解决问题。提出了微商模式下保护消费者权益的建议。针对目前我国微商侵权的特点和原因,笔者认为:首先,应当完善相关法律法规。包括:应当明确社交平台的责任、完善公益诉讼制度。其次,构建基于微信公众号的工商监管机制。包括:建立微商分类电子准入制度、建立针对微商的移动在线纠纷解决机制。第三,落实社交平台的监管责任。包括:实行微商实名认证、建立社交平台上第三方支付制度、信用评价和黑名单制度、社交平台先行赔付制度。
[Abstract]:In recent years, with the popularity of smartphones and the rapid increase in the number of mobile social software users, more and more people begin to pay attention to the enormous commercial value of social platforms. That is derivative quotient. Because of easy entry, simple operation, flexible and free work, the derivative has achieved explosive development. However, there is no clear legal regulation and lack of regulatory measures similar to traditional online shopping. In addition, the weak sense of good faith of the operators leads to violence, excessive propaganda, overspread of fake goods and other chaotic phenomena in the development of micromerchants. The legitimate rights and interests of consumers are infringed upon and the difficulty of protecting their rights and interests increasingly affects the healthy development of the whole industry. How to protect the legitimate rights and interests of consumers in the mode of derivative quotient is an urgent problem in front of us. In addition to the introduction and conclusion, there are three parts in the text. The first part puts forward the question. In view of the fact that the derivative is a new type of shopping mode, On the basis of this, the author compares the derivative shopping with traditional shopping and online shopping. Secondly, the author points out that the protection of consumers' rights and interests in the derivative shopping is faced with the following problems: the tort of the derivative is hidden. It is difficult to realize the consumer's claim right under the derivative mode, and the consumer's rights protection cost is high under the derivative mode. The second part is the analysis of the reason why the consumer's rights and interests are infringed in the derivative shopping. First of all, the author analyzes the reason why the consumer's rights and interests are infringed. It is the reason of legislation, including: the responsibility of the social platform relied on by the derivative is not stipulated; there are defects in the public interest litigation system; secondly, the dilemma of the industrial and commercial supervision and enforcement, including the lack of the market access system of the derivative; Third, the social platform lacks the supervision of the derivative, including: no real name certification and guarantee, the cost of infringement is very low, the derivative transactions transfer directly, the property security is difficult to guarantee; In the third part, the author puts forward some suggestions to protect the rights and interests of consumers under the model of derivative quotient. In view of the characteristics and reasons of tort of derivative business in our country, the author thinks: first of all, We should perfect the relevant laws and regulations, including: the responsibility of social platform should be clarified, and the public interest litigation system should be improved. Secondly, we should build a supervision mechanism for industry and commerce based on WeChat Official account. Establish mobile online dispute resolution mechanism for micro merchants. Third, implement the regulatory responsibility of social platform. Including: implementation of the derivative real name certification, the establishment of social platform third-party payment system, credit evaluation and blacklist system, Social platform advance payment system.
