论我国快递服务中消费者权益法律保护

【摘要】:随着电子商务的高速发展和“互联网+”概念的兴起,快递行业空前快速增长。我国快递业已经连续三年保持了超过两位数的增长,且长期增速超过50%。进入2016年以来,通过中间平台进行的非面对面交易突飞猛进,推动快递业进一步上升和变革。如今,通过快递进行货物运输已经成为许多人日常生活一项重要内容,如网购物品的传递,证件、票据的传递等等。然而在消费者享受方便、快捷、高效快递服务的同时,其消费者权益却屡遭受到侵害,无法得到很好的保障。保障快递服务中消费者的合法权益,不但具有法理依据,更重要的是具有实践意义。本文正是在这样的背景下,从保护快递服务中消费者合法权益的角度出发,结合我国快递行业现实状况,分析消费者权益受损原因、现行保护制度不足等的基础上,试图提出一些可行的建设性对策,以期给予快递服务中消费者更完善的保护。文章分为六个部分论述我国快递服务中消费者权益法律保护问题,主要内容如下:第一部分为绪论,是本文提出问题部分,此部分主要对快递行业、消费者、服务消费以及快递服务中消费者权益保护等概念问题进行概述,以案例形式提出快递行业普遍存在侵犯消费者权益的行为,但由于种种原因导致消费者获得救济难度较大,因此需要保护其合法权益。第二部分是文章的第二章,主要是对保护快递服务中消费者权益进行概述,其中主要包括保护快递服务中消费者权益的经济法和民法法理分析,现行的保护措施以及对快递合同法律关系进行分析并指出其不足之处。第三部分是文章的第三章,主要论述快递服务消费者权益保护的现状。分析快递服务侵害消费者权益的主要情形,以及对快递服务中消费者合法权益屡屡受到侵害的原因进行分析。第四部分是文章的第四章,主要参考和借鉴国外对于快递服务中消费者权益保护立法的和监管制度等相关规定。本章主要参考美国和德国的相关规定,并提出可借鉴的经验。第五部分是文章的第五章,是本文的解决问题部分,主要是提出完善符合我国国情的快递服务消费者权益保护制度,其中主要包括健全法律法规、完善快递行业的监管体系、减低维权成本、试行快递服务强制小额保险制度以及保障消费者个人信息等具体的解决方法,以期能为快递行业消费者权益保护提供一定的完善建议。第六部分为结语,基于上述的分析,保护快递服务中消费者权益,既有法理依据也有现实意义,而且有外国经验借鉴,应该在此基础上完善符合我国国情的快递服务中消费者权益保护制度,切实保护处于弱势地位的消费者的合法权益。
[Abstract]:With the rapid development of e-commerce and the rise of the concept of Internet, express delivery industry is growing rapidly. China's express delivery industry has maintained more than double-digit growth for three consecutive years, and the long-term growth rate is more than 50. Since 2016, non-face-to-face transactions through intermediate platforms have soared, driving the industry to further rise and transform. Nowadays, express delivery of goods has become an important part of the daily life of many people, such as the transmission of goods purchased online, documents, bills and so on. However, while consumers enjoy convenient, fast and efficient express service, their rights and interests are repeatedly infringed, which can not be well protected. Protecting the legitimate rights and interests of consumers in express delivery service has not only legal basis, but also practical significance. In this context, from the point of view of protecting the legitimate rights and interests of the consumers in express delivery service, this paper analyzes the reasons for the damage of consumers' rights and interests and the insufficiency of the current protection system, combining with the reality of express delivery industry in China. This paper tries to put forward some feasible and constructive countermeasures in order to give more perfect protection to consumers in express service. The article is divided into six parts to discuss the legal protection of consumers' rights and interests in express delivery service in China. The main contents are as follows: the first part is the introduction, which is the part of the question, this part is mainly for the express industry, consumers, This paper summarizes the concept of service consumption and the protection of consumers' rights and interests in express service, and puts forward in the form of cases that there is widespread infringement of consumers' rights and interests in express delivery industry. However, due to various reasons, it is more difficult for consumers to obtain relief. It is therefore necessary to protect their legitimate rights and interests. The second part is the second chapter of the article, mainly summarizes the protection of the rights and interests of consumers in express delivery services, which mainly includes the economic law and civil law analysis of the protection of the rights and interests of consumers in express delivery services. The present protection measures and the legal relationship of express delivery contract are analyzed and their shortcomings are pointed out. The third part is the third chapter of the article, mainly discusses the current situation of courier service consumer rights and interests protection. This paper analyzes the main situation of infringing on consumers' rights and interests by express delivery service, and analyzes the reasons why consumers' legitimate rights and interests are frequently infringed in express service. The fourth part is the fourth chapter of the article, the main reference and reference for the express delivery service consumer rights and interests protection legislation and regulatory system and other relevant provisions. This chapter mainly refers to the relevant provisions of the United States and Germany, and puts forward the experience that can be used for reference. The fifth part is the fifth chapter of the article, which is the problem solving part of this paper. It mainly proposes to perfect the system of protecting the rights and interests of express delivery service consumers, which mainly includes perfecting the laws and regulations, perfecting the supervision system of express delivery industry. To reduce the cost of protecting rights, to try out the compulsory micro-insurance system of express service and to protect the personal information of consumers, and so on, in order to provide some perfect suggestions for the protection of consumers' rights and interests in express delivery industry. The sixth part is the conclusion, based on the above analysis, to protect the rights and interests of consumers in express delivery service, both legal basis and practical significance, and foreign experience, On this basis, we should perfect the system of protecting the rights and interests of the consumers in the courier service in accordance with the national conditions of our country, and protect the legitimate rights and interests of the consumers in a weak position.
