我国快递行业市场监管研究

【摘要】:快递行业作为一种新兴独立的行业,是我国市场经济的重要组成部分,在降低流通成本、支撑电子商务、服务生产生活、扩大就业渠道等方面的积极作用日益显现。然而由于政府对快递行业市场监管不力,甚至市场监管缺位,我国快递行业发展依然面临诸多问题。因此如何对快递行业进行市场监管,是值得我们深思的话题。本论文将深刻探讨我国快递行业市场监管的现状及困境,并结合国际上典型国家的市场监管经验,提出完善我国快递行业市场监管的对策建议。本论文具体由以下由六部分构成:第一章绪论。笔者在绪论中阐述了我国快递行业市场监管的背景及意义、国内外研究现状、研究思路与方法以及主要创新点与不足之处。第二章我国快递行业市场监管的理论基础。首先,介绍了快递服务与市场监管的涵义;其次,解释了市场失灵理论、市场风险理论、政府职能理论与政府规制理论,并且阐述了这些理论在快递行业市场监管中的应用。第三章我国快递行业市场监管的现状与困境。第一,笔者从四个维度分析了我国快递行业发展的概况;其次,笔者通过表格的形式呈现了我国快递行业市场监管的现状及总体情况;第三,探讨了我国快递行业市场监管的困境,即市场监管标准不明确、监管主体不明、监管客体参差不齐以及快递行业信息不标准;最后,分析了我国快递行业市场监管困境产生的原因,即市场监管立法体系不完善、快递行业市场监管体制不健全、市场准入与退出监管不力与快递行业市场信息披露制度不完善。第四章国外快递行业市场监管典型经验与启示。首先,研究了美国、德国和日本关于快递行业市场监管的经验;其次,总结出典型国家快递行业市场监管经验对我国的启示,即准确定位监管部门、健全快递行业法律体系、倡导行业自律与坚持监管创新。第五章完善我国快递行业市场监管的对策建议。笔者提出了完善我国快递行业市场监管的对策建议,即加强快递市场法制化建设、建立健全快递行业市场监管体制、完善快递行业市场准入与准出的监管、规范快递行业市场信息披露制度与推动快递行业市场监管国际合作,以期对我国当前快递行业市场监管工作提供一定的参考。第六章全文总结与展望。笔者对全文进行总结,并对未来我国快递行业市场监管寄予了深厚的希望。
[Abstract]:As a new and independent industry, express delivery industry is an important part of market economy in our country. It plays an increasingly active role in reducing circulation cost, supporting electronic commerce, serving production and life, expanding employment channels and so on. However, the development of express delivery industry in China still faces many problems due to the lack of government supervision over the express industry and even the absence of market supervision. Therefore how to carry on the market supervision to the express delivery industry, is worth our deep thought topic. This paper will deeply discuss the present situation and predicament of the market supervision of express industry in our country, and combine the experience of market supervision of typical countries in the world, put forward the countermeasures and suggestions to perfect the market supervision of express industry in our country. This thesis is composed of six parts: the first chapter is introduction. In the introduction, the author expounds the background and significance of the market supervision of express delivery industry in China, the current research situation at home and abroad, the research ideas and methods, as well as the main innovation points and deficiencies. The second chapter is the theoretical basis of market supervision of express delivery industry in China. First, it introduces the meaning of express service and market supervision; secondly, explains the theory of market failure, market risk, government function theory and government regulation theory, and expounds the application of these theories in express industry market supervision. The third chapter is the current situation and predicament of the market supervision of express delivery industry in China. First, the author analyzes the development of express industry in China from four dimensions; secondly, the author presents the status quo and overall situation of express industry market supervision through the form of tables. Third, This paper probes into the difficulties of market supervision in express delivery industry in China, that is, the market supervision standard is unclear, the subject of supervision is unclear, the object of supervision is uneven, and the information of express industry is not standard. This paper analyzes the reasons for the difficulties in the market supervision of express industry in China, that is, the imperfect legislative system of market supervision, the imperfect supervision system of express market, the weak supervision of market access and withdrawal and the imperfect disclosure system of market information in express industry. Chapter four: typical experience and enlightenment of foreign express market supervision. First of all, it studies the experience of the express delivery industry market supervision in the United States, Germany and Japan. Secondly, it summarizes the enlightenment of the typical countries' market supervision experience to our country, that is, to accurately locate the supervision department and perfect the express delivery industry legal system. Advocate industry self-discipline and adhere to regulatory innovation. The fifth chapter consummates our country express industry market supervision countermeasure suggestion. The author puts forward the countermeasures and suggestions to perfect the market supervision of express industry in China, that is, to strengthen the legal construction of express delivery market, to establish and perfect the supervision system of express industry market, to perfect the supervision of market access and permission of express industry. Standardizing the market information disclosure system of express delivery industry and promoting international cooperation in market supervision of express industry are expected to provide some reference for the current market supervision of express industry in China. Chapter six summarizes and prospects the full text. The author summarizes the full text, and the future express industry market supervision placed deep hope.
