【摘要】：我国电子商业汇票从产生到现在已经有七年的时间,经过人民银行等相关部门和各商业银行的努力,电子商业汇票业务已经取代了部分纸质票据业务,在实践中也逐渐被人们所接受。然而电子商务在我国的起步相对滞后,发展进程迟缓,在电子商业汇票实务领域的发展过程中表现更为突出。同时又受制于我国现行票据法律规范,使得我国电子商业汇票的适用范围和社会接受程度受到了严重影响,其发展状况并未达到预期的效果。而发展过程中存在的一系列亟待解决的法律问题更是在很大程度上限制了电子商业汇票系统的推广和相关票据业务的顺利开展。因此,有必要就现存的法律问题,具有针对性地展开探讨、论述,从而达到丰富理论、促进实务的现实效果。首先本文立足于电子商业汇票与传统票据的不同之处,运用比较研究的方法对比分析,发现问题。同时又结合当下发生的最新案例,对问题的出现进行了具体的分析,配套法律规范的不尽完善、电子商业汇票丧失后救济途径的缺失、以及监管工作的不到位等问题都大大阻碍了电子商业汇票的推广和适用。然后就这些问题对其他国家、地区和国际组织的相关法律进行了考察,试图从中寻找可以借鉴和参考的地方。最后,秉着分析问题并解决问题的写作目的,对发展我国电子商业汇票进行了法律思考。通过完善配套法律规范来解决电子商业汇票对现行法律规范的排除适用的问题,通过加强安全性防控和完善监管体系来确保电子商业汇票在实践中的安全性,通过明确各方当事人的法律责任来消除持票人失票后救济手段相对缺失的后顾之忧。
[Abstract]:It has been seven years since the emergence of electronic commercial bills of exchange in China. Through the efforts of relevant departments such as the people's Bank of China and other commercial banks, electronic commercial bills of exchange have replaced some of the paper bills business. In practice is also gradually accepted by people. However, the start of electronic commerce in China lags behind, the process of development is slow, and it is more prominent in the field of electronic commercial bills. At the same time, the scope of application and social acceptance of electronic commercial bills of exchange in our country have been seriously affected by the current legal norms of bills of exchange in our country, and the development of them has not reached the desired effect. In the process of development, there are a series of legal problems that need to be solved to limit the promotion of electronic commercial bill system and the smooth development of related bill business to a great extent. Therefore, it is necessary to discuss and discuss the existing legal problems in order to enrich the theory and promote the practical effect. Firstly, based on the differences between electronic commercial bills and traditional bills, this paper uses the method of comparative analysis to find out the problems. At the same time, combined with the latest cases, this paper makes a concrete analysis on the emergence of the problem, the imperfect supporting legal norms, the lack of remedies after the loss of electronic commercial bills of exchange. And the lack of supervision and other issues have greatly hindered the promotion and application of electronic commercial bills. Then it examines the relevant laws of other countries, regions and international organizations, and tries to find some references from them. Finally, with the purpose of analyzing and solving the problems, the author gives legal consideration to the development of electronic commercial bills of exchange in China. To solve the problem of the exclusion and application of electronic commercial bills from the current legal norms by perfecting the supporting legal norms, and to ensure the safety of electronic commercial bills in practice by strengthening the safety prevention and control and perfecting the supervisory system. The legal liability of the parties concerned is clarified to eliminate the relative lack of relief means after the ticket holders lose their votes.
