网络交易中消费者隐私权保护问题研究

【摘要】:随着信息技术突飞猛进的发展,网络电子手段不断普及,互联网的应用渗透到生活中的方方面面。人们的许多传统行为模式正在发生深刻的变化,传统的购物模式受到来自互联网的冲击。作为时代的新兴产物,便利的网上交易颇受推崇,网络购物群体日益庞大,网络交易额快速增加。但是,在网上消费活动蓬勃发展、人们高度依赖网络的背境下,,网络消费者的权益尤其是隐私权保护问题逐渐突显出来。 本文以界定网络交易与消费者隐私权为切入点,分析眼下网络交易中消费者隐私权受到侵害的表现,我国对消费者隐私权保护的现状及存在的问题,并结合国外网络交易消费者隐私权相关制度,提出完善我国网络交易中消费者隐私权保护制度的建议,分五个部分对网络交易中消费者隐私权保护问题进行探讨。 第一部分对网络交易与消费者隐私权做了界定,为笔者之后的论述奠定基础。首先概述网络交易的概念、类型,简要总结网络交易的主要特点;其后,通过界定消费者隐私权对网络交易中消费者隐私权的特点进行分析。 第二部分针对网络交易中消费者隐私权受到侵害的表现进行分析。这些表现主要包括三个方面:消费者隐私信息被不当收集、消费者隐私信息被不法分析利用、消费者隐私信息被非法交易。通过这三个方面的分析,笔者力图说明消费者隐私权保护面临的挑战并为下文论述完善我国消费者隐私权保护的建议提供铺垫。 第三部分主要讲述了我国目前对消费者隐私权的保护现状及存在的问题。我国没有从法律上明确肯定隐私权的独立人格权地位,法律对隐私的规定过于抽象和笼统,缺乏可操作性。 第四部分主要列举了国外网络交易中消费者隐私权保护方面的相关制度。目前,美国、欧盟、经合组织等发达国家和国际组织对网络交易中消费者隐私权的保护都制定了相关法律制度。笔者对这些国际组织和国家的网络交易消费者隐私权方面的相关法律制度进行介绍并总结他们的先进经验,以期对完善我国网络交易中消费者隐私权益保护的法律体系有所帮助。 最后一部分主要提出了完善我国网络交易中消费者隐私权保护的相关建议。这些建议包括:完善对消费者隐私权保护的法律体系,确立网络环境下消费者隐私数据保护的基本原则,明确网站经营者保护消费者隐私权的义务。同时,应加强行业自律,教育网络用户加强自我保护意识。另外,还应该发挥相关职能部门的作用,加强对网络经营商的监管,鼓励保险公司开展网络黑客保险业务。笔者希望这些建议可以提高网络交易中消费者隐私权保护的水平。
[Abstract]:With the rapid development of information technology and the popularization of network electronic means, the application of Internet permeates every aspect of life. Many of people's traditional behavior patterns are undergoing profound changes, the traditional shopping mode from the impact of the Internet. As a new product of the times, convenient online transactions are highly praised. However, with the vigorous development of online consumer activities and people relying heavily on the Internet, the rights and interests of online consumers, especially the protection of privacy, are gradually highlighted. Based on the definition of online transaction and consumer privacy, this paper analyzes the current situation and problems of consumer privacy protection in online transactions. In this paper, the author puts forward some suggestions on how to improve the system of consumer privacy protection in online transactions in China, and discusses the protection of consumer privacy in online transactions in five parts. The first part defines the online transaction and consumer privacy right, which lays the foundation for the author's later discussion. Firstly, it summarizes the concept, types and main characteristics of online transactions. Then, it analyzes the characteristics of consumer privacy in online transactions by defining consumers' right to privacy. The second part analyzes the behavior of consumer privacy infringement in online transactions. These manifestations mainly include three aspects: the improper collection of consumer privacy information, the illegal analysis and utilization of consumer privacy information, and the illegal trading of consumer privacy information. Through the analysis of these three aspects, the author tries to explain the challenges faced by the protection of consumer privacy and provide the basis for the following discussion on how to improve the protection of consumer privacy in China. The third part mainly describes the current situation and problems of consumer privacy protection in China. Our country does not affirm the independent personality right status of the right of privacy from the law clearly, the rule of privacy of the law is too abstract and general, lack of maneuverability. The fourth part mainly enumerates the related system of consumer privacy protection in foreign internet transactions. At present, the United States, the European Union, OECD and other developed countries and international organizations have formulated relevant legal systems to protect consumer privacy in online transactions. The author introduces the relevant legal system of online transaction consumer privacy in these international organizations and countries and summarizes their advanced experience. In order to perfect the legal system of consumer privacy rights and interests protection in network transactions in China. In the last part, the author puts forward some suggestions on how to improve the protection of consumer's right to privacy in China's online transactions. These suggestions include perfecting the legal system of consumer privacy protection, establishing the basic principles of consumer privacy data protection under the network environment, and clarifying the obligations of website operators to protect consumer privacy. At the same time, we should strengthen industry self-discipline and educate network users to strengthen self-protection consciousness. In addition, we should play the role of relevant functional departments, strengthen the supervision of network operators, encourage insurance companies to carry out network hacker insurance business. I hope these suggestions can improve the level of consumer privacy protection in online transactions.
